Eksistensi Penjatuhan Pidana Mati Terhadap Terdakwa Tindak Pidana Korupsi Dalam Peradilan Pidana Indonesia

Abstract

Tujuan penelitian ilmiah ini adalah untuk mengetahui bagaimana formulasi hukuman mati dalam hukum positif di Indonesia dan kaitannya dengan eksistensi penerapan pidana mati dalam kasus korupsi di Indonesia. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan perbandingan. Hasil studi menunjukkan bahwa terdapat konfil norma antara Pasal 2 ayat (2) UU Tipikor menyatakan bahwa dalam hal tindak pidana korupsi sebagaimana dimaksud dalam ayat (1) dilakukan dalam keadaan tertentu, pidana mati dapat dijatuhkan, sedangkan dalam Pasal 9 ayat (1) UU HAM menyatakan bahwa setiap orang berhak untuk hidup, mempertahankan hidup dan meningkatkan taraf kehidupannya. Eksistensi penerapan hukum Pasal 2 ayat (2) UU Tipikor di Indonesia terbilang nihil. Belum pernah ada putusan pengadilan yang menjatuhi pidana mati dalam perkara korupsi. Kesulitan adalah untuk menjerat pelaku dengan pasal 2 ayat (2) dengan syarat keadaan tertentu sebagaimana dimaksud dalam UU Tipikor. Namun terdapat contoh yang sebenarnya dapat dijerat dengan hukuman mati karena disangka melakukan korupsi pada saat bencana alam nasional, akan tetapi penegak hukum tidak menggunakan ketentuan pasal 2 ayat (2) UU Tipikor untuk menjerat pelaku.

ABSTRACT


The purpose of this scientific journal is to find out how the formulation of the death penalty in positive law in Indonesia and its relation to the existence of the application of the death penalty in corruption cases in Indonesia. This study uses a normative legal research method with a statutory and comparative approach. The results of the study show that there is a conflict of norms between Article 2 paragraph (2) of the Anti-Corruption Act which states that in the case of a criminal act of corruption as referred to in paragraph (1) is committed under certain circumstances, the death penalty can be imposed, whereas in Article 9 paragraph (1) of the Human Rights Law states that everyone has the right to live, to maintain life and to improve their standard of living. The existence of the application of the law of Article 2 paragraph (2) of the Corruption Act in Indonesia is fairly nil. There has never been a court decision that has sentenced him to death in a corruption case. The difficulty is to ensnare the perpetrator with article 2 paragraph (2) on the condition that certain circumstances as referred to in the Corruption Act. However, there are examples that can actually be charged with the death penalty for allegedly committing corruption during a national natural disaster, however law enforcers do not use the provisions of Article 2 paragraph (2) of the Corruption Act to prosecute the perpetrators.
