PEMIDANAAN TERHADAP PENOLAKAN VAKSINASI COVID-19 DI INDONESIA DALAM PERSPEKTIF INFORMED CONSENT

Abstract

Pemidanaan terhadap masyarakat yang menolak vaksinasi covid-19 menjadi salah satu cara pemerintah Indonesia untuk menyukseskan upaya dalam memutus penyebaran covid-19 yang bertolak belakang dengan prinsip informed consent pada hukum kesehatan. Penelitian ini bertujuan untuk menganalisis pengaturan informed consent dalam instrumen hukum nasional serta pandangan terhadap pemidanaan masyarakat yang menolak vaksinasi covid-19 dari perspektif informed consent. Jurnal ilmiah ini disusun dengan mempergunakan metode penelitian hukum normatif melalui pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian menunjukkan bahwa prinsip informed consent secara spesifik diatur pada Pasal 56 ayat (1) UU. No. 36 Tahun 2009 tentang Kesehatan yang mengatur bahwa setiap orang berhak untuk menentukan persetujuan ataupun menolak seluruh atau sebagian tindakan medis yang akan dilakukan kepadanya setelah mendapatkan informasi yang menyeluruh dari petugas medis. Informed consent memberikan pandangan bahwasannya setiap individu berhak atas informasi kesehatan yang komprehensif serta menentukan persetujuan atas pertolongan medis yang akan diberikan kepadanya secara sukarela, sehingga pemidanaan bagi masyarakat yang menolak vaksinasi covid-19 bertolak belakang dengan prinsip hak informed consent yang berlaku dalam hukum kesehatan di Indonesia.


Criminalizing citizens who refuse covid-19 vaccination is one of the ways the Indonesian government to succeed in efforts to cut the spread of covid-19 which is contrary to the principle of informed consent in health law. The study is aimed to analyze the arrangement of informed consent principle in national legal instruments as well as views on the punishment of people who refuse Covid-19 vaccination from an informed consent perspective. This scientific journal is prepared using normative legal research methods with a conceptual and statutory approach. The results of the study indicate that the principle of informed consent is specifically regulated in Article 56 paragraph (1) of the Law. No. 36 of 2009 concerning Health which regulates that every person has the right to determine the approval or rejection of all or part of medical actions that will be performed on them after receiving comprehensive information from medical personnel. Informed consent provides the view that everyone has the right to comprehensive health information and determines consent for medical assistance that will be provided to him or her voluntarily, so that convictions for people who refuse Covid-19 vaccination are contrary to the principles of informed consent rights applicable in health law in Indonesia.
