The PENGATURAN BATAS MAKSIMAL TERHADAP WAKTU PENGISIAN POSISI WAKIL KEPALA DAERAH SAAT TERJADI KEKOSONGAN

Abstract

Penelitian ini bertujuan untuk memberi informasi berkaitan dengan mekanisme proses dipilihnya wakil kepala daerah berlandaskan demokrasi di Indonesia dan untuk melakukan analisis terhadap pengaturan batas maksimal terhadap waktu pengisian posisi wakil kepala daerah saat terjadi kekosongan. Metode yang dipergunakan pada artikel terkait Pengaturan batas maksimal terhadap waktu pengisian posisi wakil kepala daerah saat terjadi kekosongan ini yakni penelitian hukum dengan jenis yuridis normative serta pendekatan perundang-undangan sebagai pisau analisis dalam membahas permaalahan yang muncul pada artikel ini. Dalam penelitian ini ditemukan bahwa ini mekanisme pemilihan wakil kepala daerah berlandaskan demokrasi di Indonesia dilakukan tiap 5 (lima) tahun sekali dengan cara bersama-sama pada tiap wilayah NKRI. Tiap-tiap calon kepala daerah serta wakil kepala daerah yang bisa ikut serta dalam pemilihan wajib menjalani proses uji publik seperti aturan yang telah ada. Proses dipilihnya wakil kepala daerah dilaksanakan secara langsung, yakni secara sepaket dengan kepala daerah. Dengan demikian, posisi kepala daerah serta wakil kepala daerah di analogikan sebagai rekan yang tak dapat dipisahkan, baik dari segi pemangku jabatan publik pada saat melakukan pengelolaan wilayah ataupun pemegang posisi pemimpin di daerah. Selanjutnya terkait pengaturan batas maksimal terhadap waktu pengisian posisi wakil kepala daerah saat terjadi kekosongan belum adanya pengaturan secara khusus, hal ini menyebabkan terjadinya kekosongan norma, hal ini berimplikasi kepada tidak berjalannya dengan baik fungsi tata negara Indonesia.

This study is designed to provide information related to the mechanism of the process of selecting a deputy regional head based on democracy in Indonesia and to analyze the maximum limit setting for the time to fill the position of deputy regional head when a vacancy occurs. The method used in the article related to setting the maximum limit on the time to fill the position of deputy regional head when this vacancy occurs is legal research with a normative juridical type and a statutory approach as an analytical tool in discussing the problems that arise in this article. In this study it was found that the mechanism for selecting regional deputy heads based on democracy in Indonesia is carried out once every 5 (five) years in a joint manner in each region of the Republic of Indonesia. Each candidate for regional head and deputy regional head who can participate in the election must undergo a public examination process according to existing regulations. The process of selecting the deputy regional head is carried out directly, namely in a package with the regional head. Thus, the positions of regional heads and deputy regional heads are analogous to being inseparable partners, both in terms of public office holders when managing the region or holding leadership positions in the region. Furthermore, regarding the setting of the maximum limit on the time to fill the position of deputy regional head when a vacancy occurs, there is no specific regulation, this causes a norm void, this has implications for the improper functioning of the Indonesian state administration.
