PERLINDUNGAN HUKUM DAN UPAYA PENANGGULANGAN ANAK KORBAN EKSPLOITASI SEBAGAI PENGEMIS DI DENPASAR

Abstract

Penelitian ini mempunyai tujuan dalam mengkaji dan menganalisis perlindungan hukum dan faktor- faktor yang menghambat upaya penanggulangan eksploitasi anak khususnya eksploitasi anak yang dipekerjakan sebagai pengemis di Kota Denpasar dengan berdasarkan pada Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak (UUPA). Penelitian ini menggunakan metodologi hukum empiris yang mengkaji peraturan perundang-undangan maupun konsep-konsep hukum yang berkaitan dengan efektifitas dan implementasi dari UUPA yang berkaitan dengan eksploitasi anak sebagai pengemis. Hasil dari penelitian ini memperlihatkan bagaimana pemerintah Kota Denpasar memberikan perlindungan hukum serta bagaimana meminimalisir faktor-faktor yang menghambat upaya dalam menanggulangi eksploitasi anak sebagai pengemis di Kota Denpasar. Perlindungan hukum dan upaya penanggulangan eksploitasi anak sebagai pengemis merupakan perlindungan khusus yang pelaksanaannya wajib sesuai dengan UUPA agar menjamin hak-hak anak untuk dapat tumbuh, berkembang, dan hidup ecara maksimal dalam kerangka harkat dan martabat kemanusiaan, dilindungi dari macam kekerasan hak serta eksploitasi. Akan tetapi, terbukti dalam pengimplementasian peraturan perundang-undangan tersebut masih belum terlihat keefektifan pemerintah, lembaga perlindungan anak, serta segenap elemen masyarakat memandang eksploitasi anak sebagai hal yang urgensi untuk segera ditangani, karena hal ini bersangkutan dengan hak anak yang patut dipenuhi untuk kemajuan Negara. Sehingga seluruh anak bangsa dapat menjadi generasi penerus yang sehat, beradab dan terpenuhi hak asasi manusianya.  This research aims to examine and analyze legal protection and factors that hinder efforts toKata kunci : Anak, Eksploitasi, Pengemis combat child exploitation, especially the exploitation of children employed as beggars in Denpasar City based on Law No. 35 of 2014 on Child Protection (UUPA). This research uses empirical legal methodologies that examine laws and regulations and legal concepts related to the effectiveness and implementation of the UUPA related to the exploitation of children as beggars. The results of this study show how the Denpasar City government provides legal protection and how to minimize factors that hinder efforts to overcome child exploitation as beggars in Denpasar City. Legal protection and efforts to combat the exploitation of children as beggars are special protections whose implementation must be in accordance with the UUPA in order to ensure the rights of children to be able to grow, develop, and live optimally within the framework of human dignity and dignity, protected from various kinds of rights violence and exploitation. However, it is evident in the implementation of the legislation that it is still not seen the effectiveness of the government, child protection agencies, and all elements of society view child exploitation as an urgency to be addressed immediately, because this is related to the rights of children that must be fulfilled for the progress of the State. So that all the nation's children can become the next generation who are healthy, civilized and fulfilled their human rights. Keywords: Children, Exploitation, Beggars
