ANALISIS KEDUDUKAN HAKIM AD HOC DI PENGADILAN HUBUNGAN INDUSTRIAL
Abstract
Penelitian ini dilakukan bertujuan guna menganalisis tata cara pengangkatan hakim ad hoc dan independensi hakim ad hoc di Pengadilan Hubungan lndustrial. Metode yang dipergunakan pada penelitian ini adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual dan analisis. Hasil analisis dari studi ini menerangkan tata cara pengangkatan hakim ad hoc di Pengadilan Hubungan lndustrial memiliki sejumlah syarat khusus yang bersifat wajib, yaitu seorang hakim harus memiliki pengetahuan yang luas dalam bidang ilmu perburuhan. Calon hakim ad hoc yang diusulkan oleh masing-masing organisasinya tersebut diseleksi terlebih dahulu dan diuji dengan tata cara yang tercantum pada ketentuan Peraturan Menteri Tenaga Kerja dan Transmigrasi Republik lndonesia Nomor PER-01/MEN/Xll/2004, guna menjamin keahliannya di bidang ilmu perburuhan. Berdasarkan Keputusan Presiden yang mendapatkan usul dari Ketua Mahkamah Agung, seorang hakim bisa diangkat sebagai hakim ad hoc di Pengadilan Hubungan lndustrial apabila telah melewati proses seleksi dan rekrutmen. Kecakapan dan kegigihan seorang hakim dalam menghormati komitmen kebebasan profesinya dan integritas dalam melaksanakan kewajiban dan kewenangan dari adanya intervensi pihak lain merupakan independensi hakim ad hoc di Pengadilan Hubungan lndustrial dalam memeriksa suatu perkara. Hal tersebut diperlukan agar hakim dalam melaksanakan kewajibannya tidak berpihak kepada salah satu pihak yang bersengketa.
ABSTRACT
This research was conducted with the aim of analyzing the procedures for appointing ad hoc judges and the independence of ad hoc judges at the Industrial Relations Court. The method used in this study is a normative legal research method with statutory, conceptual and analytical approaches. The results of the analysis from this study explain that the procedure for appointing ad hoc judges at the Industrial Relations Court has a number of special conditions that are mandatory, namely that a judge must have extensive knowledge in the field of labor science. The prospective ad hoc judges proposed by their respective organizations are pre-selected and tested according to the procedures listed in the Regulation of the Minister of Manpower and Transmigration of the Republic of Indonesia Number PER-01/MEN/Xll/2004, in order to guarantee their expertise in the field of labor science. Based on a Presidential Decree which received a recommendation from the Chief Justice of the Supreme Court, a judge can be appointed as an ad hoc judge at the Industrial Relations Court if he has passed the selection and recruitment process. The skill and persistence of a judge in respecting his commitment to freedom of profession and integrity in carrying out his obligations and authority from the intervention of other parties constitutes the independence of an ad hoc judge at the Industrial Relations Court in examining a case. This is necessary so that the judge in carrying out his obligations does not side with one of the parties to the dispute.
