PENYEBARAN CUPLIKAN FILM DI MEDIA SOSIAL SEBAGAI BENTUK PELANGGARAN HAK CIPTA

Abstract

Penelitian ini bertujuan untuk memahami dan mendalami tentang bentuk pelanggaran hak cipta dan upaya proteksi hukum atas penyebaran cuplikan film di media sosial. Metode penulisan ini menggunakan metode penelitian normatif. Dengan pendekatan perundang- undangan dan konseptual. Hasil penelitian ini menunjukkan bahwa perbuatan mengutip, menyalin, merekam, menggandakan dan mengiklankan sebagian atau keseluruhan ciptaan orang lain, tanpa seizin dari pencipta atau pemegang hak cipta merupakan pelanggaran hak cipta. Oleh karena itu, ini merupakan pelanggaran terhadap hak moral dan hak ekonomi Pencipta. Penyebaran cuplikan film sebagai bentuk pelanggaran hak cipta merupakan contoh dari pembajakan. Walaupun sifatnya sementara, namun hal tersebut tetap melanggar hak cipta suatu film. Therefore, it is a violation of the moral rights and economic rights of the Creator. The dissemination of film footage as a form of copyright infringement is an example of piracy.
