ANALISIS YURIDIS PASAL 504 KITAB UNDANG-UNDANG HUKUM PIDANA (KUHP)

Abstract

Penelitian ini bertujuan  sebagai persyaratan dalam menempuh studi S1 pada fakultas hukum universitas udayana. Serta menganalisis adanya norma kosong pada Kitab Undang-Undang Hukum Pidana yang selanjutnya disebut (KUHP) pada Pasal 504. Metode yang digunakan adalah pendekatan yang mengkaji peraturan perundang-undangan serta menganalisis peraturan tersebut. Hasil dari penelitian ini menunjukan bahwa Pasal 504 KUHP terdapat kekosongan norma, sehingga diperlukan adanya penemuan hukum oleh Hakim untuk mengisi kekosongan hukum dalam KUHP tersebut.

ABSTRACT

This research aims to fulfill the requirements for pursuing undergraduate studies at the Udayana University law faculty. As well as analyzing the existence of empty norms in the Criminal Code, hereinafter referred to as (KUHP) in Article 504. The method used is an approach that examines statutory regulations and analyzes these regulations. The results of this research show that in Article 504 of the Criminal Code there is a void in norms, so that a legal discovery by the Judge is needed to fill the legal void in the Criminal Code.
