FENOMENA NO VIRAL NO JUSTICE TERHADAP PENYELESAIAN PERKARA PIDANA DIKAJI DARI ASAS KEPASTIAN HUKUM

Abstract

Penelitian ini bertujuan untuk mengeksplorasi apakah fenomena “No Viral No Justice” menciptakan efisiensi dalam penyelesaian kasus atau justru mencerminkan standar ganda dalam penegakan keadilan. Metode yang akan digunakan pada penelitian ini adalah metode penelitian hukum normatif, penelitian ini mengkaji terkait penerapan asas kepastian hukum dalam penyelesaian perkara hukum yang menjamin bahwa hukum harus jelas, konsisten, dan dapat diprediksi. Penelitian ini juga menggunakan pendekatan konseptual (conceptual approach) yang menunjukkan bahwa kasus-kasus yang viral cenderung mendapat perlakuan berbeda dibandingkan kasus yang tidak viral, menimbulkan kesenjangan dalam penegakan hukum. Hasil penelitian ini menekankan pentingnya profesionalisme aparat penegak hukum dan tanggungjawab media dalam menjaga integritas sistem peradilan, serta kesadaran kritis masyarakat dalam menyikapi informasi yang viral di media sosial. Penelitian ini membahas fenomena “No Viral No Justice” yang merujuk pada kebutuhan akan viralitas demi mendapatkan suatu Keadilan. Fenomena ini mengacu pada situasi dimana kasus-kasus hukum atau pelanggaran yang tidak mendapatkan perhatian publik melalui media sosial atau menjadi viral di internet cenderung tidak mendapatkan keadilan yang sama dengan kasus yang mendapat sorotan di media sosial. Hal tersebut menimbulkan kekhawatiran terhadap penerapan asas kepastian hukum, di mana penegakan hukum seharusnya berlaku secara konsisten dan tidak tergantung pada popularitas suatu kasus di mata publik.

This study aims to explore whether the phenomenon of "No Viral No Justice" creates efficiency in resolving cases or reflects double standards in enforcing justice. The method that will be used in this study is the normative legal research method, this study examines the application of the principle of legal certainty in resolving legal cases which guarantees that the law must be clear, consistent, and predictable. This study also uses a conceptual approach which shows that viral cases tend to be treated differently than non-viral cases, creating gaps in law enforcement. The results of this study emphasize the importance of the professionalism of law enforcement officers and the responsibility of the media in maintaining the integrity of the justice system, as well as the critical awareness of the public in responding to information that goes viral on social media. This study discusses the phenomenon of "No Viral No Justice" which refers to the need for virality in order to obtain justice. This phenomenon refers to a situation where legal cases or violations that do not get public attention through social media or go viral on the internet tend not to get the same justice as cases that get the spotlight on social media. This raises concerns about the application of the principle of legal certainty, where law enforcement should apply consistently and not depend on the popularity of a case in the public eye.
