PERLINDUNGAN HAK CIPTA ATAS KONTEN AUDIO PODCAST YANG DIUNGGAH SECARA ILEGAL DI TIKTOK INDONESIA

Abstract

Tujuan dilakukan penulisan artikel jurnal penelitian ini yaitu untuk mengetahui perlindungan hukum dalam bidang Hak Cipta atas konten Podcast berbasis audio visual dan dengan mudahnya diunggah secara ilegal di Tiktok Indonesia. Metode pengkajian yang dipakai dalam pengkajian artikel jurnal ini adalah menggunakan metode penelitian normatif dengan metode penelitian deskriptif diiringi dengan pendekatan Undang-Undang (Statute Approach) serta pendekatan yuridis normatif. Hasil dari analisis pembahasan pada artikel jurnal ilmiah dengan kesimpulan bahwasannya konten-konten audio podcast yang diunggah secara ilegal pada platform Tiktok Indonesia tanpa seizin dari pencipta atau pemilik hak dari konten tersebut merupakan pelanggaran hak cipta. Hak Cipta bertujuan untuk melindungi pencipta seperti yang diatur dalam Pasal 1 ayat 1 UU Hak Cipta dan Pasal 25 UU ITE. Hak Cipta meliputi hak ekonomi dan hak eksklusif milik pencipta. Mengenai akibat hukum dari individu yang mengunggah secara ilegal di Tiktok akan dikenakan sanksi berupa tuntutan penyesuaian ganti rugi yang bersinambungan dengan ketentuan-ketentuan yang termakhtub di Undang-Undang Hak Cipta, khususnya Pasal 99(1) dan Pasal 26(2) Undang-Undang ITE serta melalui jalur gugatan pidana sesuai dengan Pasal 112 UU Hak Cipta. Pelaksanaan hal-hal tersebut dilakukan karena individu yang melanggar telah melawan hukum serta merugikan para pencipta konten.

The intention of writing this research journal article is to discover the legal protection in the copyright field for audio-visual based Podcast content and easily uploaded illegally on Tiktok Indonesia. The research method used in writing this journal article is to use normative research methods with descriptive research methods accompanied by a statute approach with a normative juridical approach. The anylist result of the discussion in the scientific journal article with the conclusion that the audio podcast content uploaded illegally on the Tiktok Indonesia platform without the permission of the creator or owner of the rights of the content is a copyright violation. Copyright aims to protect creators as stipulated in Article 1 paragraph 1 of the Copyright Law and Article 25 of the ITE Law. Copyright includes economic rights and exclusive rights belonging to the creator. Regarding the legal consequences of individuals who upload illegally on Tiktok, they will be subject to sanctions in the form of compensation claims in accordance with Article 99 paragraph 1 of the Copyright Law and Article 26 Paragraph 2 of the ITE Law as well as through criminal lawsuits is based on Article 112 of the Copyright Law. The implementation of these things is carried out because individuals who violate the law have violated the law and harmed the content creators.
