PERLINDUNGAN TERHADAP KONSUMEN TERKAIT PENJUALAN TABUNG OKSIGEN KOSONG OLEH PELAKU USAHA DI MASA PANDEMI

Abstract

Virus covid-19 kian merebak diberbagai negara termasuk Indonesia. Kebutuhan Alat Medis dan obat – obatan kian meningkat bersamaan dengan melonjaknya kasus covid-19. Para Pelaku usaha melihat bencana sebagai kesempatan untuk memperkaya diri sendiri dengan cara menimbun alat medis. Hal tersebut membuat alat medis menjadi langka dipasaran sehingga mulai beredar produk kesehatan palsu. Salah satu produk kesehatan palsu yang beredar saat ini adalah tabung oksigen kosong. Di tulisnya jurnal bertujuan untuk menelaah bentuk perlindungan hukum apa saja yang di dapatkan konsumen terkait perilaku curang pelaku usaha yang mengadarkan tabung oksigen  kosong serta bentuk pertanggung jawaban pelaku usaha terkait masalah tersebut. Jurnal ini menggunakan  metode penelitian normatif yang mengacu pada sumber perundang – undangan, buku, dan jurnal. Pendekatan yang digunakan adalah statue approach dan fact approach. Hasil penulisan ini yaitu perlindungan hak konsumen atas kesehatan serta keselamatan saat menggunakan produk telah secara hukum dilindungi dalam Undang – Undang Perlindungan Konsumen. Kata kunci : Perlindungan Konsumen , Covid – 19 , Pelaku Usaha , Tabung Oksigen ABSTRACT Covid-19 virus is increasingly spreading in various countries, including Indonesia. The need for medical equipment and medicines is increasing along with the soaring cases of covid-19. Business actors see disaster as an opportunity to enrich themselves by hoarding medical equipment. This makes medical devices become scarce in the market so that fake health products began to circulate. One of the fake health products currently circulating is an empty oxygen cylinder. In Writing of this journal is to get understand  what is legal protections that consumers get regarding the fraudulent behavior of busineses actors who distribute empty oxygen cylinders and the form of responsibility of busines actors related to this problem. The study methoed use in this journal is a normative research method that refers to sources of legislation, books, and journals. The approach used is the statue approach and also the fact approach. The results of this paper are legal protection for consumers regarding their rights to health and safety in using products that have been legally protected in the Consumer Protection Act. Key Words : Consumer Protection , Covid 19, Bisnis Actors, Oxygen Tube
