PERLINDUNGAN HUKUM TERHADAP KONSUMEN TERKAIT PENJUALAN PRODUK BARANG PALSU DENGAN BUNDLING SECARA E-COMMERCE

Abstract

Penelitian ini memiliki tujuan untuk menambah pemahaman hukum mengenai aspek hukum penjualan produk barang bundling secara E-Commerce dan memahami perlindungan hukum terhadap konsumen terkait penjualan produk barang palsu dengan bundling secara E-Commerce. Penelitian ini menggunakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konsep yang dianalisa dengan menggunakan metode analisis deskriptif. Hasil penelitian dari penulisan ini menunjukkan aspek hukum penjualan produk barang bundling secara E-Commerce secara implisit dan eksplisit diatur didalam UU No. 8 Tahun 1999 tentang Perlindungan Konsumen, Kitab Undang-Undang Hukum Perdata, UU No. 7 Tahun 2014 tentang Perdagangan, dan Peraturan Pemerintah No. 80 Tahun 2019 tentang Perdagangan Melalui Sistem Elektronik. Berdasarkan UU PK diatur dalam Pasal 7, Pasal 8, dan Pasal 10 UU PK. Berdasarkan KUH Perdata tercantum dalam pasal 1320 dan Pasal 1338. Merujuk pada UU Perdagangan diatur dalam pasal 3 huruf j, pasal 65 dan pasal 66. Sedangkan dalam PP PMSE diatur dalam Pasal 13 ayat 1, Pasal 13 ayat 2, dan pasal 18 ayat 1. Perlindungan hukum terhadap konsumen akibat penjualan produk barang palsu dengan Bundling secara E-Commerce didasarkan kepada keberadaan UU PK, UU Perdagangan, UU ITE, dan PP PMSE. Keberadaan UU PK mengatur mengenai hak-hak konsumen dan kewajiban pelaku usaha. UU Perdagangan mengatur kewajiban pelaku usaha, penyelesaian sengketa, dan sanksi administratif. UU ITE mengatur bagian penjualan barang secara E-Commerce melalui sanksi pidana dan sanksi denda. Merujuk pada PP PMSE sebagai lex specialis dari peraturan umum sebelumnya dalam memberikan perlindungan konsumen.


ABSTRACT


This study aims to increase legal understanding of the legal aspects of selling bundling products in E-Commerce and understand legal protection for consumers related to the sale of counterfeit goods products by bundling in E-Commerce. This research uses normative legal research using a statutory approach and a concept approach that is analyzed using descriptive analysis methods. The results of this research show that the legal aspects of selling bundling products in E-Commerce are implicitly and explicitly regulated in Law No. 8 of 1999 concerning Consumer Protection, the Civil Code, Law No. 7 of 2014 concerning Trade, and Government Regulation No. 80 of 2019 concerning Trade Through Electronic Systems. Based on the PK Law, it is regulated in Article 7, Article 8, and Article 10 of the PK Law. Under the Civil Code it is listed in article 1320 and Article 1338. Referring to the Trade Law, it is regulated in article 3 letter j, article 65 and article 66. Meanwhile, the PP PMSE is regulated in Article 13 paragraph 1, Article 13 paragraph 2, and article 18 paragraph 1. Legal protection for consumers due to the sale of counterfeit goods products by Bundling on an E-Commerce basis is based on the existence of the PK Law, Trade Law, ITE Law, and PP PMSE. The existence of the PK Law regulates the rights of consumers and the obligations of business actors. The Trade Law regulates the obligations of business actors, dispute resolution, and administrative sanctions. The ITE Law regulates the sale of goods by E-Commerce through criminal sanctions and fines. Referring to PP PMSE as a lex specialis from previous general regulations in providing consumer protection.
