PERLINDUNGAN HUKUM PENGGUNAAN PODCAST SEBAGAI SUARA LATAR DALAM VIDEO TIKTOK TANPA IZIN
Abstract
Studi ini memiliki tujuan guna mengkaji regulasi atau pengaturan hukum terkait hak ipta podcast dan perlindungan hukum pada hak cipta podcast yang digunakan sebagai suara latar pada video TikTok tanpa izin dari pencipta. Metode yang digunakan pada studi ini adalah metode penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan serta pendekatan analisis konsep hukum. Hasil pada studi ini mengungkapkan bahwa Podcast merupakan suatu karya cipta berbentuk rekaman suara yang berbeda dengan radio konvensional. Sebagai karya yang memiliki hak cipta, podcast telah mendapatkan perlindungan dari Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta seperti yang tercantum pada Pasal 40 ayat (1) huruf b, yakni Podcast dapat disamakan dengan jenis karya rekaman seperti ceramah, kuliah, pidato, dan lain-lain. Hak cipta otomatis berlaku saat karya telah terwujud, meskipun begitu pencatatan dapat digunakan sebagai bukti kepemilikan hak cipta. Dalam upaya memberi perlindungan pada karya cipta podcast, pemilik hak cipta dapat melakukan dua upaya yakni menggunakan upaya preventif atau menggunakan upaya represif dalam menyelesaikan permasalahannya.
The focus of this research is to determine legal regulations related to copyright and legal protection for podcast copyright used as background sound in TikTok Videos without permission. This study employs a normative legal research method, utilizing a statute-based approach and an analysis of legal concepts. The findings of the study indicate that Podcasts are a product shaped as sound recordings that are different from conventional radio. As a creative work, podcasts are protected according to Article 40, Paragraph (1), point b of Law Number 28 of 2014 regarding Copyright where Podcasts can be equated with other types of recorded works such as lectures, courses, speeches, etc. Copyright automatically applies when the work has been created, however registration is recommended to strengthen proof of copyright ownership. In an effort to provide protection for podcast copyrighted works, copyright owners can take two measures, that are preventive efforts and repressive efforts in solving the problem.
