PEMANFAATAN PROGRAM ARTIFICIAL INTELLIGENCE DALAM MENANGKAL TINDAK PIDANA PERDAGANGAN ORANG DI INDONESIA
Abstract
Tujuan studi ini untuk mengkaji kendala penanggulangan terhadap tindak pidana perdagangan orang di Indonesia serta pemanfaatan program artificial intelligence sebagai solusi dalam menangkal tindak pidana tersebut. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statue approach) dan konseptual (conceptual approach). Hasil studi menunjukkan bahwa upaya penanggulangan tindak pidana perdagangan orang yang sudah dilakukan oleh pemerintah dan aparat penegak hukum melalui diterbitkannya Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang, serta adanya pembentukan Gugus Tugas Pencegahan dan Penanganan TPPO belum cukup efektif untuk diterapkan di Indonesia dikarenakan adanya kendala maraknya pemalsuan data dan dokumen terhadap paspor calon pekerja migran. Dalam mengatasi kendala tersebut, dibutuhkan adanya upaya dengan melakukan pemanfaatan kecanggihan teknologi inovasi melalui pengembangan platform data suatu program artificial intelligence dapat meningkatkan kemampuan pemerintah dan aparat penegak hukum dalam mendeteksi dan mencegah terjadinya kejahatan human trafficking, khususnya pendeteksian terhadap pemalsuan data dan dokumen pada paspor calon pekerja migran.
The purpose of this study is to examine the obstacles to overcoming the criminal act of human trafficking in Indonesia and the use of artificial intelligence programs as a solution in preventing this criminal act. This study uses normative legal research methods with a statutory and conceptual approach. The results of the study show that efforts to overcome the crime of trafficking in persons that have been carried out by the government and law enforcement officials through the issuance of Law Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons, as well as the formation of a Task Force for the Prevention and Handling of TIP are not effective enough to be implemented in Indonesia due to the problem of widespread falsification of data and documents in the passports of prospective migrant workers. In overcoming these obstacles, efforts are needed to utilize sophisticated technological innovation through the development of a data platform, an artificial intelligence program that can improve the ability of the government and law enforcement officials to detect and prevent human trafficking crimes, especially detecting falsification of data and documents in the passports of prospective migrant workers.
