PENGATURAN SISTEM PAYLATER DALAM TRANSAKSI PEMBELIAN DAN PENJUALAN ONLINE PADA MARKETPLACE

Abstract

Tujuan dari penelitian untuk mengetahui pengaturan sistem pay-later pada transaksi jual beli online dan perlindungan hukum perjanjian transaksi elektronik dengan sistem pay-later. Penulisan ini memakai metode penelitian normatif yakni pendekatan secara perundang-undangan (statue approach) serta pendekatan secara analisis (analytical approach). Hasil dari penelitian pengaturan sistem pay later tercantum dalam Kitab Undang-Undang Hukum Perdata, Undang-Undang Informasi dan Transaksi Elektronik, dan Peraturan Otoritas Jasa Keuangan. Di dalam peraturan-peraturan tersebut mengatur syarat-syarat sahnya perjanjian elektronik yang beritikad baik dan memberikan dasar yang cukup jelas dan kuat bagi berlakunya perjanjian kredit online khususnya pelaksanaan perjanjian kredit Pay Later. Perjanjian dalam sistem pay later memenuhi syarat Pasal 1320 Kitab Undang-Undang Hukum Perdata, yaitu dilakukan dengan kontrak elektronik. Dalam Undang-Undang Informasi dan Transaksi Elektronik juga diatur mengenai kontrak elektronik tersebut. Selanjutnya, pinjaman online juga diatur pada Peraturan Otoritas Jasa Keuangan No. 77/POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi. Dari segi hukum, perjanjian pay later menyertakan 3 pihak: penerima pinjaman (konsumen), pemberi pinjaman (penyedia layanan pay later), dan penyedia/pengelenggara layanan (fintech). Perlindungan hukum terkait dengan perjanjian transaksi elektronik dengan sistem pay later, diatur dalam Undang-Undang Perlindungan Konsumen (Undang-Undang No. 8 Tahun 1999), Undang-Undang Informasi dan Transaksi Elektronik (Undang-Undang No. 11 Tahun 2008), dan Peraturan Otoritas Jasa Keuangan No. 77 Tahun 2016.


ABSTRACT


The aim of the research is to determine the regulation of the pay-later system in online buying and selling transactions and the legal protection of electronic transaction agreements with the pay-later system. This writing uses normative research methods, namely a statutory approach and an analytical approach. The results of research on pay later system regulations are listed in the Civil Code, the Information and Electronic Transactions Law, and the Financial Services Authority Regulations. These regulations regulate the legal conditions for electronic agreements in good faith and provide a fairly clear and strong basis for the implementation of online credit agreements, especially the implementation of Pay Later credit agreements. Agreements in the pay later system fulfill the requirements of Article 1320 of the Civil Code, namely that they are carried out using electronic contracts. The Information and Electronic Transactions Law also regulates electronic contracts. Furthermore, online loans are also regulated in Financial Services Authority Regulation no. 77/POJK.01/2016 concerning Information Technology-Based Money Lending and Borrowing Services. From a legal perspective, a pay later agreement includes 3 parties: the loan recipient (consumer), the lender (pay later service provider), and the service provider/organizer (fintech). Legal protection related to electronic transaction agreements with a pay later system, is regulated in the Consumer Protection Law (Law No. 8 of 1999), the Electronic Information and Transactions Law (Law No. 11 of 2008), and Regulations Financial Services Authority No. 77 of 2016.
