Konsepsi Hak Moral atas Karya di Era Artificial Intelligence: Dialektika Hukum dalam Perspektif Paradigma Konstruktivisme
Abstract
The development of artificial intelligence has posed significant challenges to the concept of moral rights within Indonesia's intellectual property law framework. This study aims to analyze the construction of moral rights for works generated by AI through the lens of legal constructivism. Employing a normative legal research methodology with legislative and philosophical approaches, the study examines the existing legal framework and its implications for the protection of moral rights in the artificial intelligence era. The findings reveal that the construction of moral rights in Indonesia is anchored in an anthropocentric concept, prioritizing human consciousness and creative intent. Artificial intelligence, as an entity lacking consciousness or moral interests, cannot be deemed a subject of moral rights in the traditional sense. The study concludes that a reformulation of the legal framework is necessary to accommodate the complexities of artificial intelligence-driven creative ecosystems while preserving the essence of moral rights protection, which remains human-centered.
