Hak Waris Laki-Laki Nyentana dalam Perspektif Hukum Adat Waris Bali

This study aims to examine the inheritance rights of men who marry nyentana to inheritance in their family of origin according to Balinese customary law. This research uses a normative research method, and utilizes a statutory and conceptual approach. The results of the study concluded that according to "Balinese inheritance law", a son who marries "nyentana" does not have inheritance rights in his original family because he is considered to have left the kedaton. However, after the establishment of the Pesamuhan Agung III Main Council of Pekraman Village (MUDP) Bali in 2010, boys who marry nyentana have limited space to inherit. However, the Decision of the Supreme Council III of the Pekraman Village Main Assembly (MUDP) does not automatically apply as Balinese customary law, before the values ??and principles on that Decision adheres into the awig-awig of traditional villages.

Penelitian ini bertujuan untuk mengkaji hak waris laki-laki yang kawin nyentana terhadap harta warisan di keluarga asalnya menurut hukum adat Bali. Penelitian ini menggunakan metode penelitian normatif, serta memanfaatkan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian menyimpulkan bahwa menurut “hukum adat waris Bali”, anak laki-laki yang kawin ”nyentana” tidak memiliki hak waris dalam keluarga asalnya karena ia dianggap ninggal kedaton. Pasca ditetapkannya Pesamuhan Agung III Majelis Utama Desa Pekraman (MUDP) Bali tahun 2010, anak laki-laki yang kawin nyentana memiliki ruang untuk mewaris yang sifatnya terbatas. Walaupun demikian, Keputusan Pesamuan Agung III Majelis Utama Desa Pekraman (MUDP) tidak serta merta berlaku sebagai hukum adat Bali, sebelum nilai-nilai dan prinsip-prinsip yang dalam ketentuan Keputusan a quo awig-awig desa adat.
