URGENSI KEBERLAKUAN PROSEDUR DISMISSAL DALAM PERADILAN TATA USAHA NEGARA

Abstract

Tujuan dibuatnya tulisan ini adalah untuk mengkaji bagaimana prosedur dismissal dalam Peradilan Tata Usaha Negara dari segi tahapan dan urgensi keberlakuannya. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan komparatif. Hasil studi menunjukkan bahwa prosedur dismissal ini merupakan salah satu tahapan awal setelah masuknya gugatan dalam Peradilan Tata Usaha Negara yang melibatkan hakim untuk memeriksa gugatan yang masuk apakah telah memenuhi syarat atau tidak. Pentingnya mengenai prosedur dismissal dalam Peradilan Tata Usaha Negara, selain sebagai bentuk pembeda dari hukum acara pada peradilan-peradilan umum dan peradilan lainnya, juga bertujuan untuk memudahkan jalannya pemeriksaan pokok sengketa oleh Hakim, dan ditambah dengan keberlakuan asas keaktifan hakim dalam prosedur dismissal ini serta tidak serta merta semua gugatan yang telah didaftarkan itu bisa diloloskan keseluruhan.

ABSTRACT

The purpose of this paper is to examine how the dismissal process in the State Administrative Court is carried out in terms of the stages and urgency of its implementation. This study uses a normative legal research method with a statutory and comparative approach. The results of the study indicate that this dismissal process is one of the initial stages after the entry of a lawsuit in the State Administrative Court which involves a judge to examine whether the incoming lawsuit has fulfilled the requirements or not. The importance of the dismissal process in the State Administrative Court, apart from being a different form of procedural law in general courts and other courts, also aims to facilitate the examination of the subject matter of the dispute by judges, and coupled with the application of the principle of active judges in this dismissal process and not immediately all the lawsuits that have been registered can be passed in their entirety.
