Maraknya kasus jual beli online melalui sistem pembayaran COD (Cash On Delivery) oleh konsumen yang tidak bertanggung jawab menjadi pusat perhatian publik saat ini, dimana sudah banyak pelaku usaha yang dirugikan dikarenakan sistem COD ini. Penelitian ini menginvestigasi implikasi meningkatnya teknologi dan informasi terhadap pergeseran aktivitas jual beli dari offline ke online, khususnya dalam konteks e-commerce dengan sistem pembayaran Cash on Delivery (COD). Fokus penelitian adalah untuk memahami fenomena wanprestasi konsumen dalam pembayaran COD dan mengeksplorasi tanggung jawab konsumen atas kerugian yang mungkin dialami oleh pelaku usaha, dengan merujuk pada Undang-Undang Perlindungan Konsumen (UUPK) dan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE). Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, yang menganalisis berbagai isu hukum yang berkaitan dengan aktivitas jual beli online dan mekanisme pembayaran COD. Hasil penelitian menyoroti pentingnya pemahaman konsumen terhadap prosedur dan kewajiban mereka dalam transaksi e-commerce, serta perlunya e-commerce untuk menyediakan informasi yang jelas dan memberikan perlindungan kepada semua pihak yang terlibat dalam transaksi tersebut.

ABSTRACT


The rise of cases of buying and selling online with the Cash On Delivery (COD) payment system by irresponsible consumers is the center of public attention at this time, where many business actors have been harmed because of this COD payment system. In cases where the business actor has carried out his obligation to pack and deliver the ordered goods to the consumer, the consumer does not carry out his obligations properly, namely paying for the goods he has ordered and has been sent to the intended address even though the goods have been opened on the grounds that the goods ordered did not match the item he thought or did not prepare cash to be used to pay for the item. The problems that occur have raised debate about how and who should be responsible for losses due to the COD payment system. To answer this problem, normative legal research methods are used by analyzing secondary data, so that it is concluded that the responsibility for the COD payment system is shared between business actors and e-commerce in accordance with UUPK and UU ITE. Business actors who suffer losses as a result of consumer actions can ask for compensation by filing a default suit against consumers.
