PERAN PEMERINTAH DAERAH DALAM MELINDUNGI NILAI EKONOMI ATAS INDIKASI GEOGRAFIS DI INDONESIA

Abstract

ABSTRAK

Tujuan dalam penelitian ini ialah untuk dapat memahami terkait dengan peran pemerintah daerah dalam melindungi nilai ekonomi atas indikasi geografis di Indonesia. Indikasi geografis menjadi ciri khas rezim kekayaan intelektual yang merupakan aset kelas masyarakat tertentu yang menunjukkan coraknya yang unik dan layak dihormati dan dilindungi oleh siapapun, termasuk pemerintah daerah serta Negara harus melindungi demi terhindar dari pihak ataupun daerah lain yang ingin mengklaim. Metode penelitian yang dipergunakan yakni jenis penelitian hukum normatif dengan sifat deskriptif analitis terkait peran pemerintah daerah dalam upaya perlindungan hak ekonomi atas indikasi geografis dan implikasi perlindungan nilai ekonomi indikasi geografis berdasarkan “Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis”. Pemerintah daerah mempunyai peranan krusial serta strategis demi mendorong pertumbuhan ekonomi daerah seperti dalam hal pendaftaran, pembinaan, pengawasan dan pemberian perlindungan terhadap indikasi geografis. Meski dapat memberikan nilai ekonomi yang tinggi, kesadaran masyarakat terhadap pentingnya pencatatan indikasi geografis masih rendah. Dibutuhkan kesadaran hukum dari rakyat serta peranan pemerintah daerah guna mencatat produk daerahnya sebagai elemen perlindungan hak ekonomi atas indikasi geografis.

ABSTRACT

The aim of this research is to understand the role of local government in protecting the economic value of geographical indications in Indonesia. Geographical indications are characteristic of intellectual property regimes that are assets of a certain class of people that show their unique complexion and deserve to be respected and protected by anyone, including local governments and the State must protect in order to avoid other parties or regions that want to claim. The research method used is a type of normative legal research with an analytical descriptive nature related to the role of local governments in efforts to protect economic rights to geographical indications and the implications of economic value protection of geographical indications based on "Law Number 20 of 2016 concerning Brands and Geographical Indications". Local governments have a crucial and strategic role in order to encourage regional economic growth such as in terms of registration, guidance, supervision and providing protection for geographical indications. Although it can provide high economic value, public awareness of the importance of recording geographical indications is still low. It requires legal awareness from the people and the role of local governments to record their regional products as an element of protection of economic rights to geographical indications.
