PERLINDUNGAN HUKUM BAGI KONSUMEN YANG DIRUGIKAN AKIBAT ADANYA WANPRESTASI DALAM PERJANJIAN JUAL BELI ONLINE DIMASA PANDEMI COVID-19
Abstract
Penelitian dari karya ilmiah ini mempunyai tujuan agar dapat mengetahui bentuk kerugian konsumen akibat adanya wanprestasi dalam perjanjian jual beli online di masa pandemi covid-19 serta perlindungan hukum terhadap konsumen yang dirugikan akibat adanya wanprestasi dalam perjanjian jual beli online di masa pandemi covid-19. Penelitian ini tergolong kedalam penelitian hukum normatif dengan menggunakan jenis pendekatan perundang-undangan dan pendekatan konseptual. Adapun hasil dari penelitian karya ilmiah ini adalah bentuk kerugian konsumen atau pembeli akibat adanya wanprestasi didalam perjanjian bertransaksi jual beli online di masa pandemi covid-19 yaitu yaitu produk atau barang yang diterima konsumen tidak sesuai dengan kesepakatan, produk atau barang yang diterima konsumen terlambat datang, barang yang diterima konsumen palsu, dan barang yang diterima konsumen cacat. Adapun perlindungan hukum bagi konsumen yang mendapatkan kerugian akibat wanprestasi di masa pandemi covid-19 diatur dalam Undang-Undang No. 11 Tahun 2008 atau UU ITE, Undang-Undang No. 8 Tahun 1999, dan Kitab Undang-Undang Hukum Perdata. Menyelesaikan sengketa jual beli online bisa melewati beberapa cara yaitu melalui peradilan umum atau bisa juga di luar pengadilan. Kata Kunci: Konsumen Wanprestasi, Jual Beli Online, Covid-19 ABSTRACT Research from this scientific paper was aimed to examine the form of consumer losses due to default in online buying and selling agreements during the covid-19 pandemic and legal protection for consumers who are harmed due to default in online buying and selling agreements during the covid-19 pandemic. This research normative legal research using a statutory approach and a conceptual approach. As for the results of this scientific research, it is a form of consumer or buyer loss due to a default in the online buying and selling transaction agreement during the covid-19 pandemic, namely the product or item received by the consumer is not in accordance with the agreement, the product or item received by the consumer is late, goods received by consumers are counterfeit, and goods received by consumers are defective. The legal protection for consumers who suffer losses due to default during the COVID-19 pandemic is regulated in Law No. 11 of 2008 or UU ITE, Law no. 8 of 1999, and the Civil Code. Resolving online buying and selling disputes can be done in several ways, namely through the general court or out of court.
