PENGATURAN ROYALTI MUSIK DAN LAGU TERKAIT PEMANFAATANNYA PADA BERBAGAI PLATFORM STREAMING BERDASARKAN PERATURAN PEMERINTAH NO/56/2021

Abstract

Artikel ini ditulis memiliki tujuan untuk mengethaui dan memberikan informasi mengenai pengaturan peranan Lembaga Manajemen Kolektif Nasional dalam mengelola royalti lagu dan/atau musik yang ditinjau dari PP Pengelolaan Royalti serta mekanisme pengelolaan royalti lagu dan/atau musik yang tidak dinaungi oleh Lembaga Manajemen Kolektif Nasional. Artikel ini menggunakan metode penelitian normatif yakni dengan menelaah hukum positif di Indonesia guna menjawab permasalahan-permasalahan yang menjadi isu hukum dalam artikel ini. LMK sangat berperan di industri musik. Karena sebagai pintu pengguna untuk dapat berhubungan kepada pencipta baik secara langsung maupun tidak langsung. LMK berperan untuk mengkolek royalti atas ciptaan yang digunakan oleh pengguna yang penciptanya terdaftar sebagai anggota di LMK tersebut. Bagi pencipta yang tidak dinaungi oleh LMK, maka dapat mengkolek royaltinya secara konvensional, namun dalam PP Pengelolaan Royalti sendiri sudah diatur mengenai apabila ada royalti yang tidak diketahui siapa penciptanya dalam kurun waktu tertentu. Kata Kunci: Royalti Lagu dan Musik, Platform Streaming, Hak Cipta ABSTRACT This article supposed to be written for the understanding and to give an information regarding the regulation of the role of the National Collective Management Institute in managing song and/or music royalties in terms of the Government Regulation on Royalty Management and the mechanism for managing song and/or musik royalties that are not covered by the National Collective Management Institute. This article uses a normative research method, namely by reviewing and analyzing the existing laws and regulations in Indonesia in order to answer the problems that become legal issues in this article. LMK plays a very important role in the musik industry. Because as a door for users to be able to relate to the creator either directly or indirectly. LMK's role is to collect royalties on works used by users whose creators are registered as members of the LMK.
