Pengaturan Penyelesaian Kredit Macet Melalui Eksekusi Jaminan Hak Tanggungan Berdasarkan Hukum Perbankan
Abstract
Tujuan studi ini untuk mengkaji kreteria kredit macet dan menganalisis penyelesaian kredit macet melalui eksekusi jaminan hak tanggungan berdasarkan hukum perbankan. Metode yang digunakan adalah metode normatif dengan cara deskriptif melalui pendekatan konseptual dan peraturan perundang-undangan. Hasil studi menunjukkan bahwa pengaturan kredit macet diatur dalam Penjelasan Pasal 44 Undang-UndangPerbankan, dan Pasal 10 sampai 12 PBI Nomor: 14/ 15 / PBI/ namun sudah diperbaharui dengan POJK Nomor 40/Pojk.03/2019, untuk pengaturan eksekusi jaminan hak tanggungan diatur dalam undang-undang perbankan yaitu Pasal 12A ayat (1) dan ayat (2) beserta penjelasannya.

ABSTRACT
The purpose of this study is to examine the criteria for bad credit and to analyze the settlement of bad loans through the execution of a guarantee of mortgage under banking law. The method used is a normative method with a descriptive method through a conceptual approach and statutory regulations. The results of the study show that the regulation of bad credit is regulated in the Elucidation of Article 44 of the Banking Law, and Articles 10 to 12 of PBI Number: 14/15 / PBI / but has been updated with POJK Number 40 / Pojk.03 / 2019, to regulate the execution of guarantees of insurance rights. regulated in the banking law, namely Article 12A paragraph (1) and paragraph (2) along with the explanations thereof.
