AKIBAT HUKUM WANPRESTASI DEBITUR DALAM TRANSAKSI ELEKTRONIK MELALUI LAYANAN PAYLATER PADA APLIKASI SHOPEE

Abstract

Tujuan dari penulisan ini adalah untuk menelaah dan mengetahui bagaimana mekanisme penggunaan fitur SPayLater dan juga mengetahui akibat hukum ketika pengguna fitur tersebut melakukan wanprestasi. Metode penelitian yang digunakaan pada studi ini yaitu metode penelitian normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Hasil yang didapatkan berdasarkan studi ini yaitu mekanisme dalam penggunaan fitur SPayLater ini cukup mudah dan sederhana karena pengguna hanya perlu melakukan langkah-langkah aktivasi melalui aplikasi Shopee. Setelah proses aktivasi selesai dilakukan diperlukan waktu kurang lebih 2x24 jam untuk kemudian disetujui. Ketika telah disetujui maka pengguna akan mendapatkan notifikasi bahwa fitur SPayLater telah aktif dan dapat digunakan. Jika pengguna fitur SPayLater melakukan wanprestasi tidak akan terjadi akibat hukum karena pihak Shopee dalam menyelesaikan permasalahan ini tidak menempuh proses secara litigasi maupun non litigasi melainkan hanya diselesaikan secara internal saja yaitu pihak Shopee dapat membekukan akun pengguna, limit SPayLater pengguna dapat berkurang, keterlambatan pembayaran akan dicatat pada Sistem Layanan Informasi Keuangan (SLIK) OJK, dan selain itu juga dapat dilakukan penagihan lapangan.

The purpose of this research was to examine and find out the mechanism for using the SPayLater feature and also to find out the legal consequences when the user commited a default. The research method used in this study is a normative research method with statutory and conceptual approach. The result obtained based on this study are the mechanism for using the SPayLater feature was quite easy and simple because users only needed to perform activation steps through the Shopee application. After the activation process was complete, it will take approximately 2x24 hours to be approved. When it has been approved, the user would get a notification that the SPayLater feature was active and can be used. If a user of the SPayLater feature commited a default, there would be no legal consequences because the Shopee party in resolving this problem did not go through a litigation or non-litigation process but was only resolved internally, that the Shopee party could freeze the user's account, the user's SPayLater limit could be reduced, late payments would be recorded in the OJK Financial Information Service System, and field billing could also be carried out.
