PERLINDUNGAN BAGI PENGGUNA E-COMMERCE DALAM PERLUASAN EKONOMI GLOBAL

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui pengaturan transaksi e-commerce di Indonesia  dan untuk mengkaji  tentang perlindungan bagi pengguna e-commerce dalam perluasan ekonomi global. Penelitian ini menggunakan metode penelitian yuridis-normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa pengatiran transaksi e-commerce di Indonesia diatur dalam Peraturan pemerintah  No. 71 tahun 2019 tentang Penyelenggaraan sistem dan Transaksi Elektronik  dan Peraturan Pemerintah No. 80 Tahun 2019 tentang Perdagangan Melalui Sistem Elektronik. Namun, implementasi ini masih membutuhkan perluasan pengaturan hukum khususnya dalam transaksi melalui e-commerce sebagai perluasan ekonomi global agar tidak terjadi tumpang tindih antara aturan tersebut. Selanjutnya perlindungan hukum bagi para pengguna e-commerce sebagai perluasan ekonomi global mencakup dua bagian yaitu, perlindungan dalam perjanjian dan perlindungan di luar perjanjian. The purpose of this study is to determine the regulation of e-commerce transactions in Indonesia and to examine the protection for e-commerce users in the expansion of the global economy. This study uses a juridical-normative research method with a statutory approach. The results of the study indicate that the regulation of e-commerce transactions in Indonesia is regulated in government regulation no. 71 of 2019 concerning the Implementation of Electronic Transactions and Systems and Government Regulation No. 80 of 2019 concerning Trading Through Electronic Systems. However, this implementation still requires the expansion of legal arrangements, especially in transactions through e-commerce as an expansion of the global economy so that there is no overlap between these rules. Furthermore, legal protection for e-commerce users as an expansion of the global economy includes two parts, namely, protection within the agreement and protection outside the agreement.
