PERLINDUNGAN HAK CIPTA KREATOR TIKTOK ATAS KONTEN CIPTAANNYA SEBAGAI KARYA SINEMATOGRAFI

Abstract

Studi ini bertujuan untuk menelaah kepastian hukum dalam perlindungan hak cipta terhadap kreator TikTok atas video ciptaannya sebagai salah satu hak cipta karya sinematografi. Adapun studi ini termasuk sebagai suatu penelitian hukum normatif dengan menggunakan statute approach. Berdasarkan hasil penelitian ini menunjukkan bahwa terkait hubungan  hukum yang timbul antara kreator TikTok sebagai pengguna platform dengan pihak TikTok sebagai agen elektronik baru akan mengikat para pihak bilamana telah didasarkan dengan syarat sahnya kontrak elektronik menurut Pasal 46 ayat (2) PP No. 71 Tahun 2019 dan ketentuan klausula baku sesuai Pasal 18 ayat (1) UU PK. Kemudian berkaitan dengan penjaminan perlindungan hak cipta terhadap para kreator TikTok masih menimbulkan persoalan hukum, hal ini dikarenakan ketentuan layanan TikTok yang memuat perjanjian lisensi berpotensi melanggar ketentuan Pasal 82 UU HC yang menentukan pembatasan dalam mengadakan suatu perjanjian lisensi.

This study aims to examine the legal certainty in copyright protection of TikTok creators for their videos as one of the copyrights for cinematographic works. This study is included as a normative legal research using a statute approach. Based on the results of this study, it shows that the legal relationship that arises between TikTok creators as platform users and TikTok as a new electronic agent will bind the parties when it has been based on the legal conditions of an electronic contract according to Article 46 paragraph (2) PP No. 71 of 2019 and the provisions of standard clauses in accordance with Article 18 paragraph (1) of the PK Law. Then with regard to guaranteeing copyright protection for TikTok creators, it still raises legal problems, this is because the provisions of TikTok's service contain a license agreement that violates the provisions of Article 82 of the HC Law which determine restrictions in entering into a license agreement.
