PENERAPAN PERDA NO 2 TAHUN 2015 TERKAIT PEDAGANG KAKI LIMA DI KOTA DENPASAR

Abstract

Penelitian ini bertujuan menganalisis Penerapan Perda No 2 Tahun 2015 Terkait Pedagang Kaki Lima di Kota Denpasar. Penelitian ini termasuk jenis penelitian hukum empiris,yaitu melihat hukum dalam artian nyata menggunakan fakta-fakta empiris dengan meneliti bekerjanya hukum di masyarakat melalui wawancara atau obervasi langsung ke lapangan. Pendekatan yang digunakan adalah yuridis sosiologis yaitu mengidentifikasi hukum sebagai institusi sosial yang nyata dan fungsional dalam sistem kehidupan yang terjadi dimasyarakat. Bahan hukum lainnya yang digunakan untuk mendukung penelitian ini adalah bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa Pengaturan mengenai Pedagang Kaki Lima sudah diatur secara nasional sehingga peraturan daerah yang dibuat oleh pemerintah Kota Denpasar berpedoman pada aturan tersebut. Oleh karena itu pemerintah Kota Denpasar membuat Perda Kota Denpasar No 2 Tahun 2015 yang khusus mengatur tentang Pedagang Kaki Lima. Hambatan – hambatan dalam penerapan Perda No 2 Tahun 2015 terkait Pedagang Kaki Lima adalah terdiri dari faktor internal dan eksternal. Faktor internal sendiri yaitu peraturan daerah yang tumpang tindih dengan aturan Desa Adat, faktor penegak hukum seperti hambatan hambatan yang tidak dapat diselesaikan oleh Satuan Polisi Pamong Praja dalam melakukan penertiban. Selanjutnya ada faktor eksternal yaitu dari faktor masyarakat dan faktor ekonomi kurangnya kesadaran pedagang kaki lima mengenai Peraturan Daerah yang berlaku dan ketimpangan ekonomi yang terjadi di masyarakat.

This study aims to analyze the application of Perda No. 2 of 2015 regarding street vendors in the city of Denpasar. This research is a type of empirical legal research, which is seeing the law in a real sense using empirical facts by examining the work of law in society through interviews or direct observations in the field. The approach used is sociological juridical, namely identifying law as a real and functional social institution in the life system that occurs in society. Other legal materials used to support this research are primary and secondary legal materials. The results showed that the regulation regarding street vendors has been regulated nationally so that the regional regulations made by the Denpasar City government are guided by these rules. Therefore, the government of Denpasar City made the Regional Regulation on the City of Denpasar No. 2 of 2015 which specifically regulates street vendors. The obstacles in the application of Perda No. 2/2015 regarding street vendors consist of internal and external factors. The internal factors themselves are regional regulations that overlap with the rules of the Traditional Village, law enforcement factors such as obstacles that cannot be resolved by the Civil Service Police Unit in controlling. Furthermore, there are external factors, namely from community factors and economic factors, the lack of awareness of street vendors regarding the applicable Regional Regulations and economic inequality that occurs in the community.
