KEPASTIAN HUKUM ATAS TANAH ADAT YANG DIKLAIM MENJADI TANAH PRIBADI

Abstract

Tujuan penelitian ini untuk menganalisis terjadinya klaim tanah adat menjadi tanah milik pribadi dan kepastian hukum terhadap status tanah adat itu. Penelitian ini mengggunakan metode penelitian hukum normatif yang berangkat dari permasalahan kekosongan norma. Penelitian ini menggunakan pendekatan perundang-undangan statue approach) dan pendekatan kasus (case approach). Hasil kajian ini yakni pengklaiman tanah adat terjadi karena tanah adat yang dikuasai oleh individual memiliki sifat menurun sebagai warisan. Hal ini menyebabkan hak penguasan individu menguat, sedangkan hak kolektif akan melemah. Kepastian hukum terhadap status tanah adat yang diklaim sebagai tanah pribadi diperoleh melalui jalur pengadilan, sebagai wujud perolehan perlindungan terhadap hak-hak kepemilikan tanah.

ABSTRACT

The purpose of this study is to analyze the occurrence of customary land claims to become privately owned land and legal certainty regarding the status of customary land. This study uses a normative legal research method that departs from the problem of the void of norms. This study uses a statutory approach (statue approach) and a case approach. The results of this study are that customary land claims occur because customary land controlled by individuals has a hereditary nature. This causes individual control rights to strengthen, while collective rights will weaken. Legal certainty regarding the status of customary land which is claimed as private land is obtained through the courts, as a form of obtaining protection for land ownership rights.
