PERJANJIAN JUAL BELI MELALUI INTERNET (E-COMMERCE) DARI ASPEK HUKUM PERDATA

Tujuan studi ini untuk memberi pengetahuan mengenai pengaturan syarat keabsahan suatu kontrak perjanjian jual beli melalui internet dan bagaimana penyelesaian sengketa serta sanksi hukum pelanggaran pelaksanaan jual beli melalui internet (e-commerce). Dalam mengkaji permasalahan pada studi ini menggunakan metode penelitian hukum normatif dengan berdasarkan buku dan peraturan perundang-undangan yang berlaku. Hasil analisis dari studi ini diketahui bahwa keabsahan kontrak tergantung pada pemenuhan syarat-syarat kontrak. Apabila syarat kontrak telah terpenuhi, sebagaimana yang tercantum pada pasal 1320 KUH Perdata maka tidak menutup kemungkinan bahwa kontrak jual beli secara transaksi e-commerce tersebut sah. Penyelesaian sengketa yang terjadi dalam perjanjian jual beli secara transaksi e-commerce apabila ada pihak yang dirugikan yaitu dapat ditempuh melalui litigasi, non litigasi, arbitrase, mediasi, negosiasi.

ABSTRACT
The purpose of this study is to provide knowledge on setting the terms of validity of a contract of sale and purchase agreement through the internet and how the dispute resolution and legal sanctions violations of the implementation of the sale and purchase through the internet (e-commerce). In examining the problems in this research, normative legal research methods are used which is based on books and applicable laws and regulations. The results of the analysis of this study indicate that the validity of the contract depends on the fulfillment of the terms of the contract. If the terms of the contract have been fulfilled, as stated in Article 1320 of the Civil Code, it is possible that the contract of sale and purchase in an e-commerce transaction is valid. Settlement of disputes that occur in the sale and purchase agreement through e-commerce transactions if there is an aggrieved party that can be reached through litigation, non-litigation, arbitration, mediation, negotiation.
