AKIBAT HUKUM TERHADAP PENGUNGKAPAN RAHASIA DAGANG OLEH BARISTA COFFEE SHOP BERDASARKAN IUS CONSTITUTUM

Abstract

Tujuan studi ini dilakukan untuk mengkaji pengaturan perlindungan hukum Rahasia Dagang terhadap pengungkapan Rahasia Dagang yang dilakukan oleh barista coffee shop. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan. Maraknya bisnis coffee shop membuat barista coffee shop melakukan kecurangan dengan melakukan pelanggaran pengungkapan Rahasia Dagang, dikarenakan pekerjanya ingin membuka bisnis coffee shop juga. Dapat diketahui bahwa bentuk pelanggaran Rahasia Dagang yang dilakukan berupa komposisi, resep, bahan biji kopi, metode khusus pembuatan minuman kopi. Hasil studi ini menunjukan bahwa pengungkapan Rahasia Dagang yang dilakukan oleh barista coffee shop dapat dikenai sanksi perdata atau sanksi pidana pada Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang

The purpose of this study was to examine the regulation of the legal protection of Trade Secrets against the disclosure of Trade Secrets by coffee shop baristas. This study uses a normative legal research method with a statutory approach. The rise of the coffee shop business makes coffee shop baristas commit fraud by violating the disclosure of Trade Secrets, because their employees want to open a coffee shop business as well. It can be see that the forms of violation of Trade Secrets are in the form of composition, recipe, ingredients for coffee beans, special methods of making coffee drinks the results of this study indicate that disclosure of Trade Secrets by coffee shop baristas can be subject to civil sanctions or criminal sanctions in Law Number 30 of 2000 concering Trade Secrets.
