PERLINDUNGAN HUKUM TERHADAP PENGGUNA NOMOR TELEPON SELULER DAUR ULANG DI INDONESIA

Abstract

Penelitian ini bertujuan untuk memahami peraturan yang mengatur praktik daur ulang nomor telepon seluler di Indonesia, serta bentuk perlindungan hukum bagi pengguna dan penyedia jasa layanan telekomunikasi terkait kerugian yang timbul akibat praktik daur ulang nomor telepon di Indonesia. Dalam pembuatan jurnal ini, metode penulisan yang penulis gunakan yaitu metode penelitian normative. Hasil dari penelitian ini yaitu adanya kekosongan norma yang berdampak kerugian akibat dari praktik daur ulang nomor telepon dan hingga saat ini belum aturan yang dibuat oleh pemerintah untuk mengatur daur ulang nomor telepon ini secara khusus. Dengan menggunakan metode konstruksi hukum melalui analogi untuk mencari penyelesaian atas kerugian yang terjadi akibat praktik daur ulang nomor telepon. Tidak adanya aturan khusus yang mengatur mekanisme daur ulang nomor telepon yang menyebabkan kerugian terhadap konsumen nomor telepon daur ulang maupun pemilik awal nomor telepon yang didaur ulang tersebut.

This research aims to understand the regulations governing the practice of recycling cellular telephone numbers in Indonesia, as well as the form of legal protection for users and providers of telecommunications services regarding losses arising from the practice of recycling telephone numbers in Indonesia. In making this journal, the writing method that the author used was the normative research method. The results of this research are that there is a vacuum in norms which results in losses resulting from the practice of recycling telephone numbers and to date no regulations have been made by the government to specifically regulate the recycling of telephone numbers. By using the legal construction method through analogy to find a solution to the losses that occur due to the practice of recycling telephone numbers. There are no specific rules governing the mechanism for recycling telephone numbers which causes losses to consumers of recycled telephone numbers and the original owners of the recycled telephone numbers.
