PENTINGNYA PENGATURAN KEMBALI TINDAK PIDANA PENGHINAAN PRESIDEN DAN WAKIL PRESIDEN

Abstract

Penelitian ini bertujuan untuk memberikan analisis perbedaan rumusan pasal yang telah dicabut oleh Mahkamah Konstitusi dengan pasal baru yang termuat dalam RUU KUHP, serta urgensi pengaturan pasal penghinaan Presiden di masa mendatang. Metode penelitian yang digunakan yaitu jenis penelitian hukum normative dengan pendekatan perundang-undangan dan analisa konsep hukum dan didukung dengan teknik pencarian data dengan studi pustaka yang sumbernya dari bahan hukum primer, sekunder, dan tersie. Hasil dari penelitian ini menemukan bahwa rumusan pasal penghinaan dalam KUHP dan RUU KUHP memiliki perbedaan. Tentunya putusan Mahkamah Konstitusi tersebut bukanlah alasan penolakan diaturnya kembali pasal tersebut di masa mendatang. Sehingga pasal penghinaan terhadap Presiden dan Wakil Presiden masih tetap relevan diatur dalam RUU KUHP.

This study aims to provide an analysis of the differences in the formulation of the articles that have been repealed by the Constitutional Court with the new articles contained in the draft criminal code, as well as the urgency of the implementation in the coming articles concerning the insults to the president. The research method used is normative legal research with a statutory approach and legal concept analysis and is supported by data research techniques with literature studies whose sources are primary, secondary and tertiary legal materials. The results of this examination confirm that the wording of the articles of the penal code and the draft penal code has differences. Indeed, the decision of the Constitutional Court n° 013-022/PUU-IV/2006 is not a reason to reject the criminal act of harassment against the President and the Vice-President which is regulated in the Draft Code Criminal. Therefore, these sections remain relevant to what is stated in the Draft Criminal Code.
