PENYELESAIAN KREDIT BERMASALAH AKIBAT DAMPAK COVID-19 DENGAN RESTRUKTURISASI KREDIT (Studi di PT. BPR PADMA Denpasar)

Abstract

Tujuan penulisan artikel ini adalah untuk mengetahui beberapa kriteria debitur yang terkena dampak Covid-19 yang berhak mendapatkan restrukturisasi atas fasilitas kreditnya di PT. BPR Padma Denpasar serta mengkaji pelaksaaan kebijakan restrukturisasi kredit sebagai upaya penyelesaian kredit bermasalah akibat dampak Covid-19 di PT. BPR Padma Denpasar. Penulisan artikel ini menggunakan metode penelitian hukum yuridis empiris melalui pendekatan perundang-undangan dan fakta. Hasil penelitan memperlihatkan bahwa beberapa kriteria debitur yang berhak mendapatkan restrukturisasi kredit meliputi seluruh debitur yang menurut penilaian Bank atas permohonan restrukturisasi yang diajukan debitur mengalami kendala dalam memenuhi kewajibannya karena terkena dampak pandemi Covid-19, lalu debitur kooperatif dan jujur dalam memberikan penjelasan mengenai kondisi debitur, serta debitur menunjukkan itikad baik untuk memenuhi kewajiban sampai kredit lunas. Pelaksanaan kebijakan restrukturisasi kredit sebagai upaya dalam menyelesaikan kredit bermasalah akibat dampak Covid-19 di PT. BPR Padma Denpasar dilakukan melalui tahapan penjadwalan kembali, penataan kembali, dan persyaratan kembali kepada seluruh debitur terdampak Covid-19.

ABSTRACT


The writing aims to find out some of the criteria for debtors affected by Covid-19 who are entitled to a restructuring of their credit facilities at PT. BPR Padma Denpasar as well as reviewing the practice of credit restructuring policies as an effort to resolve non-performing loans due to the impact of Covid-19 at PT. BPR Padma Denpasar. The writing uses methods of empirical juridical research through statutory dan fact approach. The result shows that several criteria for debtors who are entitled to credit restructuring include all debtors who, according to the Bank's assessment of the restructuring application submitted by the debtor, have difficulties in fulfilling their obligations affected by Covid-19 pandemic, then the debtor is cooperative and honest in providing an explanation of the debtor's condition, and debtors show good faith to fulfill obligations until the credit is paid. The practice of the credit restructuring policy as an effort to resolve non-performing loans affected by Covid-19 at PT. BPR Padma Denpasar is carried out through stages of rescheduling, realigning, and returning requirements to all debtors affected by Covid-19.
