ANALISIS HUKUM TERHADAP PENEGAKAN ATURAN LALU LINTAS TERHADAP WISATAWAN ASING DI BALI

Abstract

Penelitian ini bertujuan untuk menganalisis kerangka hukum yang mengatur penegakan aturan lalu lintas terhadap wisatawan asing di Bali serta mekanisme penegakan hukum yang diterapkan dalam kasus pelanggaran aturan lalu lintas oleh wisatawan asing tersebut. Metode yang digunakan dalam penelitian ini adalah studi literatur dengan menganalisis berbagai peraturan perundang-undangan terkait, seperti UU No. 22 Tahun 2009, Peraturan Gubernur Bali No. 28 Tahun 2020, dan Peraturan Daerah Provinsi Bali No. 4 Tahun 2016. Hasil studi menunjukkan bahwa kerangka hukum yang mengatur penegakan aturan lalu lintas terhadap wisatawan asing di Bali meliputi UU No. 22 Tahun 2009, Peraturan Gubernur Bali No. 28 Tahun 2020, dan Peraturan Daerah Provinsi Bali No. 4 Tahun 2016. Mekanisme penegakan hukum dilakukan melalui cara preventif dan represif, dengan prosedur yang diatur dalam PP No. 80 Tahun 2012. Sanksi yang diterapkan meliputi sanksi administratif dan pidana, dengan jenis pelanggaran yang sering terjadi antara lain melanggar rambu-rambu lalu lintas, tidak memakai helm, tidak memiliki SIM, dan melanggar batas kecepatan. Penelitian ini juga mengungkapkan perlunya sosialisasi aturan lalu lintas kepada wisatawan asing dan pentingnya peran kepolisian dalam menegakkan hukum secara tegas untuk menciptakan efek jera dan mewujudkan lalu lintas yang aman, tertib, dan lancar di Bali.

This research aims to analyze the legal framework that regulates the enforcement of traffic rules against foreign tourists in Bali as well as the law enforcement mechanisms applied in cases of violations of traffic rules by foreign tourists. The method used in this research is a literature study by analyzing various related laws and regulations, such as Law no. 22 of 2009, Bali Governor Regulation no. 28 of 2020, and Bali Province Regional Regulation no. 4 of 2016. The results of the study show that the legal framework governing the enforcement of traffic rules against foreign tourists in Bali includes Law no. 22 of 2009, Bali Governor Regulation no. 28 of 2020, and Bali Province Regional Regulation no. 4 of 2016. Law enforcement mechanisms are carried out through preventive and repressive methods, with procedures regulated in PP No. 80 of 2012. Sanctions applied include administrative and criminal sanctions, with types of violations that frequently occur including violating traffic signs, not wearing a helmet, not having a driver's license, and breaking speed limits. This research also reveals the need to socialize traffic rules to foreign tourists and the importance of the role of the police in strictly enforcing the law to create a deterrent effect and create safe, orderly and smooth traffic in Bali.
