FAKTOR PENYEBAB SERTA UPAYA PENYELESAIAN WANPRESTASI JUAL BELI MOBIL PADA SHOWROOM MOBIL BEKAS DI DENPASAR

Abstract

Tujuan dari penelitian ini yaitu untuk mengidentifikasi mengenai factor-faktor penyebab terjadinya wanprestasi serta bertujuan untuk mengetahui bagaimana upaya penyelesaian kasus wanprestasi tersebut, penelitian ini berfokus pada penyelesaian transaksi jual beli mobil bekas di Denpasar, sehingga mentode penelitian empiris yang digunakan untuk meneliti factor penyebab serta penyelesaian wanprestasi, hasil peneelitian ini menunjukan bahwa factor utama yang mnjadi penyebab terjadinya wanprestasi pada penelitian ini  ialah dikarenakan debitur telah melakukan prestasi tetapi tidak sesuai dengan isi perjanjian hal ini dikarenakan kurangnya kesadaran debitur dalam memberikan informasi mengenai kondisi keadaan mobil secara jelas sehingga wanprestasi tersebut dapat terjadi, dan upaya penyelesaian wanprestasi pada penelitian kali ini ialah dengan jalur non-litigasi dengan cara negosiasi.

The purpose of this research is to identify the factors causing breaches of contract and to explore methods for resolving such breach cases, specifically focusing on second-hand car transactions in Denpasar. The empirical research method is employed to examine the factors leading to breaches of contract and their resolution. The study reveals that the primary factor contributing to breaches of contract is the debtor's failure to fulfill obligations as agreed upon, often due to a lack of awareness in providing clear information about the condition of the vehicle. Consequently, the resolution of breaches of contract in this study is pursued through non-litigious negotiation.
