PENYELESAIAN PERKARA RANGKAP JABATAN ANGGOTA BADAN PERMUSYAWARATAN DESA (BPD) SIBANGKAJA

Abstract

Tujuan dilakukan penelitian ini untuk mengetahui faktor-faktor penyebab terjadinya pelanggaran hukum (rangkap jabatan) dan untuk mengetahui proses penyelesaian perakara rangkap jabatan. Studi ini menggunakan metode penelitian empiris dengan menggunakan jenis pendekatan perundang-undangan (The Statute Approach) dan pendekatan fakta (The Fact Approach). Hasil studi menunjukkan bahwa faktor-faktor yang menyebabkan terjadinya pelanggaran yaitu ekonomi, moral, kepentingan dan kesempatan, dengan faktor ekonomi menjadi faktor utama seseorang melanggar hukum. Penyelesaian pelanggaran rangkap jabatan dapat dilakukan dengan dua mekanisme yaitu: 1. Pengunduran diri atau 2. Pemberhentian.

ABSTRACT

The purpose of this research is to determine the factors that cause legal violations (dual positions) and to determine the process of resolving cases of multiple positions.This study uses empirical research methods using a statutory approach (The Statute Approach) and a fact approach (The Fact Approach). The results of the study show that the factors that cause violations are economic, moral, interests and opportunities, with economic factors being the main factor in someone breaking the law. Resolving violations of multiple positions can be carried out using two mechanisms, namely: 1. Resignation or 2. Dismissal.
