Perlindungan Hukum Terhadap Nasabah Kartu Kredit Dalam Proses Pembayaran Melalui Jasa Penagih Utang
Abstract
Tujuan studi ini untuk mengetahui pengaturan penggunaan jasa penagih utang oleh bank dalam menagih utang kepada nasabah pengguna kartu kredit serta menganalisis perlindungan hukum terhadap nasabah dalam proses pembayaran melalui jasa penagih utang. Metode yang digunakan yaitu penelitian hukum normatif dengan pendekatan perundang-undangan serta konseptual. Hasil studi menunjukkan pihak bank diperbolehkan menggunakan jasa penagih utang dalam penagihan utang nasabah apabila pada saat kredit nasabah pengguna kartu kredit telah digolongkan kredit macet oleh bank. Hal tersebut telah diatur dalam PBI Nomor: 14/2/PBI/2012 dan SEBI Nomor 14/17/DASP. Pihak bank wajib memberitahu nasabah pengguna kartu kredit apabila menggunakan debt collector dalam penagihan utangnya. Tenaga penagih utang harus mematuhi etika dan syarat-syarat penagihan serta pihak bank wajib melakukan pengawasan terhadap kinerja debt collectornya. Tenaga penagih utang dilarang tegas untuk melakukan kekerasan atau mempermalukan nasabah pengguna kartu kredit pada saat penagihan utang. Apabila terjadi tindakan kekerasan oleh debt collector kepada nasabah maka nasabah dapat melakukan pengaduan ke seluruh kantor bank sebagai bentuk perlindungan hukum. Mengenai pengaduan telah diatur dalam PBI Nomor: 10/10/PBI/2008.

ABSTRACT
The purpose of this study is to examine the arrangements for the use of debt collection services by banks in collecting debts from credit card users and to analyze the legal protection of credit card customers in the payment process through debt collection services. The method used is normative legal research with a statutory approach and conceptual approach. The results of the study show that banks are allowed to use debt collection services in collecting customer debt if at the time of credit, the credit card user is classified as bad credit by the bank. This has been regulated in PBI Number: 14/2 / PBI / 2012 and SEBI Number 14/17 / DASP.The bank is obliged to notify customers of credit card users if they use debt collectors in collecting their debts. Debt collectors must comply with ethics and collection requirements and banks are required to supervise the performance of their debt collectors. Debt collection personnel are strictly prohibited from committing violence or embarrassing credit card users when collecting debts. If there is an act of violence by a debt collector against a customer, the customer can file a complaint to all bank offices as a form of legal protection. Regarding complaints, it has been regulated in PBI Number: 10/10 / PBI / 2008.
