JABATAN NOTARIS DAN KODE ETIK NOTARIS: BAGAIMANA PERAN DAN FUNGSI DEWAN KEHORMATAN NOTARIS?

Abstract

Penelitian ini bertujuan untuk meneliti fungsi dan peran Dewan Kehormatan Notaris yang dibuat melalui Kongres Ikatan Notaris Indonesia (I.N.I) dalam melakukan penegakan kode etik Notaris, serta menganalisis efektivitas dan koordinasi Dewan Kehormatan Notaris dalam melakukan penegakan kode etik Notaris. Berdasarkan uraian diatas terdapat 2 (dua) rumusan masalah dalam penelitian ini yaitu pertama, meneliti tentang peran dan fungsi Dewan Kehormatan Notaris terhadap penegakan kode etik Notaris, dan kedua menganalisis efektivitas terhadap koordinasi Dewan Kehormatan Notaris sebagai lembaga penegakan kode etik Notaris di seluruh Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan menganalisis menggunakan pendekatan kualitatif, dengan metode deskriptif. Bersumberkan pada data sekunder, utamanya disertai wawancara. Hasil penelitian pertama, fungsi dan peran Dewan Kehormatan Notaris sangat dibutuhkan terhadap pengawasan dan penegakan kode etik Notaris dengan pemberian sanksi terhadap Notaris yang melakukan pelanggaran kode etik dan kedua, efektivitas serta koordinasi yang dilakukan Dewan Kehormatan Notaris merupakan bagian dalam memberikan pendapat atas dugaan pelanggaran kode etik Notaris terhadap perilaku Notaris dan jabatan Notaris kepada Majelis Pengawas Notaris.

This study aims to examine the function and role of the Notary HonorAry Council created through the Congress of the Indonesian Notary Association (I.N.I) in enforcing the Notary code of ethics, as well as analyzing the effectiveness and coordination of the Notary HonorAry Council in enforcing the Notary Code of Ethics. Based on the description above, there are 2 (two) problem formulations in this study, namely first, examining the role and function of the Notary HonorAry Council on the enforcement of the Notary Code of Ethics, and secondly analyzing the effectiveness of the coordination of the Notary HonorAry Council as an institution for enforcing the Notary Code of Ethics throughout Indonesia. The research method used is normative juridical by analyzing using a qualitative approach, with a descriptive method. Sourced to secondary data, mainly accompanied by interviews. The results of the first study, the function and role of the Notary HonorAry Council are urgently needed for the supervision and enforcement of the Notary Code of Ethics by sanctioning Notaries who violate the code of ethics and secondly, the effectiveness and coordination carried out by the Notary HonorAry Council is part of providing opinions on alleged violations of the Notary code of ethics on the behavior of notaries and the position of Notaries to the Supervisory Panel.
