PENEGAKAN KODE ETIK TERHADAP JAKSA YANG MELAKUKAN KORUPSI

Abstract

Penelitian ini bertujuan untuk mengetahui pengaturan kode etik jaksa di Indonesia dan bagaimana penyelesaian pelanggaran kode etik terhadap jaksa yang melakukan korupsi. Metode penelitian yang digunakan dalam pembuatan artikel ini adalah metode penelitian hukum normatif yaitu penelitian yang difokuskan mengkaji kaidah-kaidah atau norma yang terdapat dalam hukum positif. Berdasarkan penelitian ini Pengaturan mengenai kode etik jaksa dapat ditemukan dalam Peraturan Jaksa Agung Republik Indonesia Nomor PER-014/A/JA/11/2012 tentang Kode Perilaku Jaksa. Dalam penegakan kode etik terhadap jaksa yang melakukan Korupsi penyelesaian dilakukan melaui mahkamah kode perilaku selain itu dilakukan juga proses hukum terhadap jaksa yang bersangkutan karena perbuatan tersebut telah melanggar hukum pidana dan hukum disiplin pegawai negeri sipil yang sanksinya berupa hukuman penjara dan pemberhentian tidak dengan hormat.

This study aims to determine the regulation of the code of ethics of prosecutors in Indonesia and how to resolve violations of the code of ethics against prosecutors who commit corruption. The research method used in the preparation of this article is a normative legal research method, namely research that is focused on examining the norms or norms contained in positive law. Based on this research. Regulations regarding the code of conduct for prosecutors can be found in the Regulation of the Attorney General of the Republic of Indonesia Number PER-014 / A / JA / 11/2012 concerning the code of conduct for prosecutors. In enforcing the code of ethics against prosecutors who commit corruption, settlement is carried out through a code of conduct court. In addition, legal proceedings are also carried out against the prosecutor concerned because the act violates the criminal law and the disciplinary law for civil servants whose sanctions are in the form of imprisonment and dishonorable dismissal.
