PELAKSANAAN PERLINDUNGAN TERHADAP PEKERJA DALAM SITUASI PANDEMI COVID-19 DI DENPASAR
Abstract
Tujuan penulisan artikel ini untuk mengetahui dampak pandemi Covid-19 terhadap pengupahan para pekerja di Kota Denpasar serta untuk mengetahui pelaksanaan Surat Edaran Menteri Pekerja Tentang Pelindungan Pekerja dalam kaitannya dengan pengupahan akibat adanya pandemi Covid-19. Metode yang digunakan merupakan metode penelitian hukum empiris, yang mengkaji dan menganalisis terhadap keefektifan suatu peraturan perundang-undangan yang berlaku di masyarakat serta mencari bukti berupa fakta yang ada di lapangan. Hasil penelitian menunjukan bahwa dampak pandemi Covid-19 yang dialami pekerja di kota Denpasar mempengaruhi terhadap pemotongan upah serta PHK yang berujung kepada meningkatnya angka pengangguran dan kemiskinan. Pelaksanaan Surat Edaran Menteri Pekerja berjalan secara efektif dilihat dari kondisi para pekerja dan para pelaku usaha yang merasa terlindungi terkait dengan pengupahan yang tetap diberikan dan masih bisa melangsungkan usahanya melalui rangkaian pencegahan serta perlindungan terhadap kesehatan para pekerja dengan menerapkan protokol pencegahan Covid-19.
The purpose of this paper is to find out the impact of the Covid-19 pandemi on the wages of workers in Denpasar and to find the implementation of the Minister of Worker's Circular on Worker Protection in relation to wages due to the Covid-19 pandemi. The method used is an empirical legal research method, which studies and analyzes the effectiveness of a law in force in society and looks for evidence in the form of facts in the field. The results showed that the impact of the Covid-19 pandemi perceived by workers in Denpasar affected wage cuts and layoffs which led to increased unemployment and poverty. The implemention of Circular of the Minister of Workers is running effectively as seen from the conditions of workers and business actors who feel protected in relation to wages that are still given and can still carry out their business through a series of prevention and protection of workers' health by implementing the Covid-19 prevention protokol.
