Abstract

Penelitian ini bertujuan untuk mengkaji tentang kewenangan Judicial Review  dalam sistem peradilan di Indonesia. Penelitian ini merupakan penelitian hukum normatif, dengan metode pendekatan yang digunakan adalah Pendekatan Perundang-Undangan (statute approach), Pendekatan konseptual (conceptual approach), Pendekatan Historis (Historical Approach) dan Pendekatan Komparatif (Comparative Approach). Berdasarkan hasil penelitian, ditemukan bahwa pelaksanaan Judicial Review di Indonesia terjadi permasalahan baik secara konseptual maupun secara praktik, sehingga layak untuk di rekonsepsikan kembali konsep pengaturan Judicial Review di Indonesia, yakni dengan mengintegrasikan kewenangan Judicial Review mejadi satu atap ke Mahkamah Konstitusi.


This research aims to examine the authority of Judicial Review within the judicial system in Indonesia. This study is a normative legal research, utilizing several approaches: the Statute Approach, the Conceptual Approach, the Historical Approach, and the Comparative Approach. Based on the results of the research, it was found that the implementation of Judicial Review in Indonesia encounters problems both conceptually and practically. Therefore, it is appropriate to reconceptualize the regulation of Judicial Review in Indonesia by integrating the authority of Judicial Review under one roof, namely to the Constitutional Court.
