ANALISIS IMPLIKASI GAGASAN OMNIBUS LAW KESEHATAN SEBAGAI DASAR KEBIJAKAN LAYANAN TELEMEDISIN DI INDONESIA
Abstract
Penelitian ini bertujuan untuk mengetahui pengaturan layanan telemedisin pada gagasan omnibus law kesehatan serta untuk mengetahui implikasi gagasan omnibus law kesehatan terhadap layanan telemedisin di Indonesia. Penelitian hukum normatif digunakan pada penelitian ini, dengan pendekatan konseptual dan perundang-undangan melalui studi dokumen. Hasil penelitian ini yaitu gagasan omnibus law kesehatan berimplikasi langsung terhadap layanan telemedisin. Implikasinya berkaitan dengan aspek pengaturan layanan telemedisin terdapat pada Pasal 1 ayat (27), Pasal 22 ayat (1), (2) dan (3) dan Pasal 169 ayat (2), (3), pada pengaturan tersebut masih menimbulkan kekaburan norma terkait substansi ijin praktik dokter, belum adanya pengaturan terkait keamanan dan privasi data pasien, standar praktik dan regulasi, serta kualitas layanan telemedisin. Adanya gagasan omnibus law kesehatan khusunya layanan telemedisin masih perlu dilakukan revisi sehingga terwujud kepastian hukum.
This research aims to understand the regulation of telemedicine services under the concept of the omnibus health law and to determine the implications of the omnibus health law on telemedicine services in Indonesia. This research uses a normative legal study with a conceptual and legislative approach through document analysis. The results of this study show that the omnibus health law concept has direct implications for telemedicine services. The implications are related to the regulation aspects of telemedicine services stated in Article 1 paragraph (27), Article 22 paragraph (1), (2), and (3), and Article 169 paragraph (2), (3). However, these regulations still create ambiguity regarding the substance of doctor's practice licenses, the absence of regulations concerning patient data security and privacy, practice standards and regulations, as well as the quality of telemedicine services. The concept of the omnibus health law, especially regarding telemedicine services, still needs revision to ensure legal certainty.
