Abstract

ABSTRAK


Penelitian ini bertujuan untuk mengkaji standar keamanan operasional jasa bank yang dapat menimbulkan kerugian bagi nasabah dan tanggung jawab bank berkaitan dengan kerugian nasabah atas hilangnya uang nasabah yang tersimpan dalam tabungan pada suatu bank. Metode yang dipergunakan adalah jenis penelitian normatif dengan pendekatan perundang-undangan khususnya hukum perbankan. Hasil studi menunjukkan bahwa  sistem standar keamanan bank yang kurang maksimal memungkinkan terjadinya skimming, phising, system error, atau human error yang dapat merugikan nasabah penyimpan.Perlindungan hukum terhadap Penabung berkaitan dengan dana simpanannya di bank  dapat mengacu pada  UU Perlindungan Konsumen,Peraturan BI No. 16/1/PBI/2014 tentang Perlindungan Konsumen Jasa Sistem Pembayaran dan Peraturan OJK Nomor 1/POJK.07/2013 tentang Perlindungan Konsumen Sektor Jasa Keuangan, serta Pasal 1365 KUHPer.Pihak Bank wajib bertanggungjawab pada nasabah penyimpan dalam hal kerugian nasabah disebabkan oleh pihak Bank. Penyelesaian sengketa kerugian nasabah dapat ditempuh melalui dua proses yaitu mekanisme persidangan(litigasi) dan mekanisme diluar persidangan (non litigasi).

ABSTRACT


This study aims to review the operational security standards of bank services that can cause losses to customers and bank responsibilities related to customer losses for the loss of customer's money stored in savings at a bank. The method used is a type of normative research with a statutory approach, especially banking law. The results showed that the bank's lack of maximum security standard system allows for skimming, phishing, system error, or human error that can harm storage customers. Legal protection of depositoment customers in connection with their deposits in banks may refer to Law No. 8 of 1999 on Consumer Protection, Bank Indonesia Regulation Number 16/1/PBI/2014 concerning Consumer Protection of Payment System Services and Regulation of the Financial Services Authority Number 1/POJK.07/2013 concerning Consumer Protection of Financial Services Sector, as well as Article 1365 of the Civil Code. The Bank shall be responsible to the depositoment customer in the case of customer losses caused by the Bank. Settlement of customer loss disputes can be reached through two process, there are judicial or litigation mechanisms and non-judicial or non-litigation mechanisms.
