PERLINDUNGAN HUKUM TERHADAP EKSPRESI TRADISIONAL DALAM KAITANNYA DENGAN INVENTARISASI SEBAGAI KEKAYAAN INTELEKTUAL

Penulisan jurnal ini bertujuan untuk memberi pemahaman mengenai mengenai inventarisasi terhadap hak cipta khusunya Ekspresi Budaya Tradisional dan bentuk perlindungannya terhadap Ekspresi Budaya Tradisional sebagai salah satu kekayaan intelktual. Metode penelitian hukum normatif menjadi pilihan penulis, yang berfokus pada kajian-kajian terhadap bahan hukum yang ada. Penulisan  menggunakan beberapa pendekatan yaitu pendekatan konsep, pendekatan teori historis yaitu mendalami nilai-nilai sejarah dari bagaimana pembentukannya dengan statue approach atau pendekatan peraturan perundang-undangan menjadi pendekatan yang penulis pilih berkaitan dengan regulasi tentang hak cipta Adapun persoalan yang diangkat adalah Pengaturan dari Ekspresi Budaya Tradisional berdasarkan “Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta dan Perlindungan Hukum terhadap karya cipta sebagai Ekspresi Budaya Tradisional (EBT)” dalam kaitannya  dengan inventarisasi. Hasil dari pernelitian ini menunjukan bahwa terdapat kekaburan norma pada Undang-Undang Hak Cipta yang ketentuannya terdapat “Pasal 38 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta”.

ABSTRACT

The purpose of this journal article is to provide an understanding of how the inventory of copyright, particularly Traditional Cultural Expressions, is conducted and what forms of protection are involved. The author opted for a normative legal research method, focusing on studies of the existing legal materials. Several approaches were employed in the writing, namely the conceptual approach, the historical theory approach, delving into the historical values of how it was formed through a statutory approach or legislative regulations, which the author chose regarding copyright regulations.  The issue addressed is the Regulation of Traditional Cultural Expressions based on "Law Number 28 of 2014 concerning Copyright and Legal Protection for copyrighted works as Traditional Cultural Expressions (TCE)" concerning inventory. The results of this research indicate that there is ambiguity in the norms of the Copyright Law, particularly in the provisions of "Article 38 paragraph (1) of Law Number 28 of 2014 concerning Copyright".
