PERLINDUNGAN KONSUMEN DALAM JUAL BELI PRODUK SUSU FORMULA KEDALUWARSA PADA MINIMARKET

Tujuan penelitian adalah memberikan pemahaman perlindungan hukum bagi konsumen ketika mengalami insiden pembelian produk susu formula kedaluwarsa melalui perspektif Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Disamping itu, tujuannya juga menganalisis tanggung jawab yang diberikan oleh pelaku usaha dengan pemberian kompensasi kepada konsumen yang dirugikan. Jurnal ini menerapkan metode penelitian hukum normatif, dengan menganalisis keberlakuan UUPK serta sumber literature hukum yang berkaitan dengan kasus hukum perlindungan konsumen. Hasil penelitian menunjukkan bahwa konsumen dan pelaku usaha belum cermat mematuhi hak serta kewajibannya masing masing sesuai ketentuan UUPK. Adanya peraturan hukum perlindungan konsumen nyatanya belum memberikan kepastian hukum pemenuhan hak-hak konsumen ketika pelaku usaha lalai dalam transaksi jual-beli produk. ABSTRACT
The purpose of this study is to provide an undesrtanding of legal protection for consumers when experiencing an incident of purchasing expired formula milk products through the perspective of Law Number 8 of 1999 concerning Consumer Protection (UUPK). In addition, the aim is also to analyze the responsibilities given by business actors by providing compensation to consumers who are harmed. This journal applies a normative legal research method, by examining the validity of the UUPK and legal literature sources related to consumer protection legal cases. The study results indicate that consumers and business actors haven’t carefully complied with their respective rights and obligations according to the provinsions of the UUPK. Consumer protection laws haven’t provided legal certainty for furfilling consumer rights when business actors are negligent in product sales transactions.
