KARYA SENI CIPTAAN ARTIFICIAL INTELLIGENCE DALAM PERSPEKTIF HAK CIPTA DI INDONESIA

Kajian ini berniat demi memahami regulasi yang dibutuhkan untuk melindungi hak cipta berbentuk karya seni terhadap gambar yang dihasilkan perkembangan teknologi Artificial Intelligence atau Kecerdasan buatan. Kajian ini mengaplikasikan metode penelitian hukum normatif  dengan pendekatan menggunakan regulasi nasional dan conceptual approach. Kajian menyuratkan hasil bahwa salah satu teknologi yang baru muncul saat ini yakni, penghasilan karya seni dengan menggunakan Artificial Intelligence ini merupakan salah satu pelanggaran terhadap hak cipta karya seni yang sudah diciptakan sebelumnya. Hal ini dikarenakan penciptaan karya seni melalui Artificial Intelligence dilakukan dengan Artificial Intelligence mempelajari karya seni yang berada di dataset internet tanpa sepengetahuan izin dari penciptanya. Sehingga, secara jelas penggunaan Artificial Intelligence ini melanggar pengaturan hak cipta yang tertera pada UU no. 28 tahun 2014 dengan pasal yang diatur yaitu pasal 40 dimana karya seni merupakan hak cipta yang dilindungi.

ABSTRACT

This study intends to understand the regulations needed to protect copyright in the form of artworks for images produced by developments in Artificial Intelligence technology. This study applies normative legal research methods with an approach using national regulations and a conceptual approach. The study shows that one of the technologies that has recently emerged, namely, producing works of art using Artificial Intelligence, is a violation of the copyright of works of art that have been previously created. This is because the construction of artwork through Artificial Intelligence is carried out by Artificial Intelligence studying artwork in internet datasets without the authorization of the creator itself. So, clearly the use of Artificial Intelligence violates the copyright regulations stated in Law no. 28 of 2014 with the regulated article, namely article 40, where works of art are copyright protected.
