FENOMENA GERAKAN TERORISME DALAM PERSPEKTIF HUKUM INTERNASIONAL

Abstract

Tujuan artikel ini adalah untuk mengkaji gerakan terorisme dalam hukum internasional yang aksi  kejahatannya menjadi fenomena global dan menjadi perhatian dunia. Terorisme sendiri belum termasuk dalam bentuk kejahatan internasional. Metode penelitian yang digunakan yaitu metode penelitian normatif yang mengkaji aksi dari Gerakan tersebut sebagai suatu tindak kejahatan kemanusiaan (Crime Against Humanity) serta implikasinya terhadap hukum internasional. Terorisme adalah salah satu tindak kriminalitas yang berdimensi internasional dan sangat berpengaruh bagi kehidupan masyarakat baik masyarakat regional maupun masyarakat internasional. Gerakan terorisme merupakan suatu fenomena global yang sangat meresahkan seluruh lapisan masyarakat dunia yang terjadi di seluruh dunia  baik di negara maju maupun negara berkembang. Aksi teroris yang dilakukan telah memakan banyak korban, terutama yang berasal dari etnis minoritas. Dari perspektif hukum internasional, terorisme merupakan suatu bentuk kejahatan yang mengancam keselamatan pribadi dan mengancam kedaulatan negara. Karena perbedaan ideologi di berbagai negara, istilah “terorisme” sendiri tidak memiliki definisi yang jelas. Dalam skala internasional, organisasi Perserikatan Bangsa-Bangsa (PBB) memberikan perlindungan hukum untuk gerakan teroris ini, meskipun PBB belum memastikan bahwa kejahatan teroris adalah kejahatan internasional, terlepas dari serangannya.

The purpose of this article is to examine the terrorism movement in international law, whose crimes have become a global phenomenon and have received worldwide attention. Terrorism itself is not yet included in the form of an international crime. The research method used is a normative research method by examining the actions of the Movement as a crime against humanity (Crime Against Humanity) and its implications for international law. Terrorism is a crime that has an international dimensions and very influential on people's lives, both regional and international communities. The terrorism movement is a global phenomenon that is very disturbing to all levels of world society that occurs throughout the world, both in developing and deleveloped countries. The terrorist acts carried out have claimed many victims, especially those from ethnic minorities. From the perspective of international law, terrorism is a form of crime that threatens personal safety and national sovereignty. Due to the ideological differences of different countries, the term "terrorism" itself does not have a clear definition. On an international scale, the United Nations (UN) organization provides legal protection for this terrorist movement, although the United Nations has not yet confirmed that terrorist crimes are international crimes, regardless of the incident.
