PELAKSANAAN ASAS STRICT LIABILITY TERHADAP RUGINYA KONSUMEN
Abstract
Penulisan riset ini tujuannya untuk memahami dasar hukum pelaksanaan asas strict liability terhadap ruginya pihak konsumen dan pelaksanaan asas strict liability terhadap ruginya konsumen. Pemilihan metode penelitian yakni hukum empiris. Hasilnya yaitu sebagai landasan hukum pelaksanaan asas strict liability pada intinya termuat pada ketentuan perdata tentang keabsahan perjanjian dan tanggung jawab pelaku usaha dan juga termuat dalam ketentuan Informasi Trasaksi Elektrounik. Dalam prakteknya, asas strict liability tidak dilaksanakan oleh pihak penjual karena tidak menerima pengembalian barang yang suda dikirimnya, sehingga pertanggungannya diderita oleh pihak konsumen saja dan sekaligus menjadi resiko konsumen.

ABSTRACT
The purposed this writing the researches to understands on a legal basis or an application of the principle on strict liability for consumer losses and the implementation of the principle of strict liability for consumer losses. The choice of research method is empirical law. As a result, as a legal basis for the application of the strict liability principle, it is essentially contained in the civil provisions concerning the validity of agreements and the responsibilities of business actors and is also contained in the provisions for Electronic Transaction Information. In practice, the principle of strict liability is not applied by the seller because the seller does not accept the return of the goods he has sent, so the insurance is only borne by the consumer and is at the same time the risk of the consumer.
