Pengaturan Penentuan Upah Minimum Pekerja di Indonesia

Abstract

Jurnal ini memiliki tujuan yaitu secara umum untuk memahami pengaturan penentuan upah minimum pekerja di Indonesia dan secara khusus untuk mengetahui pengaturan penentuan upah minimum pekerja di Indonesia dan harmonisasi pengaturan penentuan upah minimum pekerja di Indonesia antara PP No 78 Tahun 2015 dengan UU Ketenagakerjaan. Metode Penelitian Normatif digunakan pada jurnal ini dan mempergunakan pendekatan perundang-undangan dan pendekatan konsep hukum. Pengaturan penentuan upah minimum pekerja di Indonesia diatur pada Pasal 88 ayat (4) UU Ketenagakerjaan dan diatur pada peraturan pelaksana pada Pasal 44 ayat (2) PP No.78 Tahun 2015. Pada Pasal 88 ayat (4) UU Ketenagakerjaan menggunakan survei kebutuhan hidup layak oleh serta memperhatikan pertumbuhan ekonomi dan produktivitas. Pasal 44 ayat (2) PP No.78 Tahun 2015 Tentang Pengupahan dalam perhitungan upah minimum menggunakan formula baku dengan kenaikan nilai upah minimum ditentukan oleh besar inflasi dan produk domestik. Harmonisasi pengaturan penentuan upah minimum pekerja di Indonesia antara PP No 78 Tahun 2015 dengan UU Ketenagakerjaan dapat diselesaikan dengan menggunakan asas asas lex superiori derogat legi inferiori, bahwa PP No.78 Tahun 2015 tidak boleh bertentangan dengan UU Ketenagakerjaan sebagai peraturan yang lebih tinggi daripada Peraturan Pemerintah, sehingga PP No.78 Tahun 2015 harus diganti atau dirubah terkait penentuan upah minimum dan harus menyesuaikan dengan UU Ketenagakerjaan.

ABSTRACT


The purpose of writing this scientific journal is in general to understand the harmonization of regulations for determining the minimum wage for workers in Indonesia and specifically to find out the regulations for determining the minimum wage for workers in Indonesia and the harmonization of regulations for determining the minimm wage for workers in Indonesia between PP No. 78 of 2015 and the Major Labour Law. The Normative Research Method is used in this journal and uses a statutory approach and a legal concept approach. The regulation for determining the minimum wage for workers in Indonesia is regulated in Article 88 paragraph (4) of the Major Labour Law and is regulated in the implementing regulations in Article 44 paragraph (2) of Government Regulation No.78 of 2015 concerning wages. In Paal 88 paragraph (4) the Major Labour Law uses a decent living needs survey by taking into account productivity and economic growth. Meanwhile, Article 44 paragraph (2) of Government Regulation No.78 of 2015 concerning Wages in calculating the minimum wage uses a standard formula with an increase in the value of the minimum wage determined by the amount of inflation and domestic product. Harmonization of regulations for determining the minimum wage for workers in Indonesia between Government Regulation No. 78 of 2015 and the Major Labour Law can be resolved using the lex superiori derogat legi inferiori principle, that PP No.78 of 2015 should not conflict with the Major Labour Law as a higher regulation than the Government Regulation, so that PP No.78 of 2015 must be replaced or amended in relation to determining the minimum wage and must conform to the Major LabourLaw.
