URGENSI PENGATURAN PERLINDUNGAN HUKUM TERHADAP PENGETAHUAN TRADISIONAL DALAM PERATURAN PERUNDANG-UNDANGAN DI INDONESIA

Abstract

Studi ini ditujukan untuk meninjau pengaturan pengetahuan tradisional yang terdapat dalam peraturan perundang-undangan serta menelaah urgensi diaturnya perlindungan pengetahuan tradisional dalam peraturan perundang-undangan di Indonesia. Studi ini menerapkan metode penelitian hukum normatif yang menerapkan tiga jenis pendekatan, yakni pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan. Hasil studi menunjukkan bahwasanya Indonesia masih memerlukan pengaturan perlindungan pengetahuan tradisional secara sui generis yang dapat diwujudkan dengan mengkaji dan mengesahkan Rancangan Undang-Undang tentang Perlindungan dan Pemanfaatan Kekayaan Intelektual Pengetahuan Tradisional dan Ekspresi Budaya Tradisional (RUU PT EBT) yang berfokus pada perlindungan positif mapun perlindungan defensif dengan melibatkan partisipasi pemerintah, masyarakat termasuk didalamnya masyarakat adat, serta stakeholders terkait.

The desired outcome of this research is to scrutinize the oversight of traditional knowledge regulations which can be found in Indonesia’s legal framework and the pressing need for compliance of safeguarding traditional knowledge through legal measures and regulations in Indonesia. Method of this study uses normative legal research methods using three kinds of approaches, inter alia the statutory regulation approach, the context approach, and the comparative approach. Output of the research shows that Indonesia still needs regulations for the sui generis protection of traditional knowledge which can be realized by reviewing and ratifying the RUU of Safeguarding and Utilization of Intangible Assets related to Traditional Knowledge and Cultural Expressions (RUU PT EBT) which focuses on positive protection and protection defensively by involving the participation of the government, the community including indigenous communities, and related stakeholders.
