PENGATURAN PEMERIKSAAN DAN PUTUSAN TINDAK PIDANA KORUPSI TANPA DIHADIRI TERDAKWA

Abstract

Tujuan daripada penulisan ini adalah untuk menganalisa mengenai pengaturan pemeriksaan dan putusan tindak pidana korupsi tanpa dihadiri terdakwa. Permasalahan yang diangkat yaitu pengaturan pemeriksaan dan putusan tindak pidana korupsi terkait tidak hadirnya terdakwa dan urgensi pemeriksaan dan putusan pada kasus tindak pidana korupsi dapat dilakukan tanpa kehadiran terdakwa. Hasil penelitian menunjukan bahwa secara normatif telah terjadi perluasan norma yang mengakibatkan terjadi memuat ketentuan yang saling berbenturan pada peraturan dalam hal penanganan perkara tindak pidana korupsi, yaitu tidak mengharuskan terdakwa hadir saat hakim membacakan hukuman dalam sebuah putusan. Sedangkan hal tersebut merupakan ketentuan hyang merubah mekanisme pelaksanaan penanganan perkara tindak pidana korupsi pada peraturan sebelumnya dengan mengharuskan terdakwa hadir saat hakim membacakan hukuman dalam setiap putusan. Berdasarkan sudut pandang akademik maka peraturan yang lebih khusus yang digunakan dalam mengadili tindak pidana korupsi sebagaimana asas Lex Specialist Derogate Legi Generalis. Urgensi pemeriksaan dan putusan pada kasus tindak pidana korupsi dapat dilakukan tanpa kehadiran terdakwa yang secara filosofis dapat dimaknai berdasarkan sudut pandang dampak dari tindak pidana korupsi yang sangat merugikan keuangan negara atau perekonomian negara dan menghambat pembangunan nasional, sehingga dengan mempercepat proses peradilan dengan prosedur yang tidak berlarut-larut dapat memastikan penanganan perkara tindak pidana dapat meminimalisir tunggakan perkara serta dapa menghadirkan adanya kepastian.


The purpose of this writing is to analyze the arrangements for examining and deciding corruption cases without the presence of the accused. The issues raised the arrangements for examining and deciding corruption crimes related to the absence of the accused and the urgency of examining and deciding on corruption cases can be carried out without the presence of the defendant. The results of the study show that normatively there has been an expansion of norms which has resulted in containing conflicting provisions in the regulations in terms of handling cases of corruption, namely not requiring the defendant to be present when the judge reads out the sentence in a decision. While this is a provision that changes the implementation mechanism for handling corruption cases in the previous regulation by requiring the defendant to be present when the judge reads out the sentence in each decision. Based on an academic point of view, more specific rules are used in trying corruption crimes according to the Lex Specialist Derogate Legi Generalis principle. The urgency of examining and deciding on corruption cases can be carried out without the presence of the accused which can be philosophically interpreted from the point of view of the impact of corruption which is very detrimental to state finances or the country's economy and hinders national development, so as to speed up the judicial process with procedures that are not protracted Dissolved can ensure the handling of criminal cases can minimize arrears in cases and can provide certainty.
